The <br />application can be considered filed and the public notice process being prior to these items being received. <br />EXHIBIT A - Legal Description and Location Map <br />Please depict the currently approved permit boundary in addition to the proposed permit <br />boundary on the location map. <br />EXHIBIT C - Mining Plan <br />(1j <br />The purpose of the mining plan is to describe how mining will affect the permit area for the <br />duration of the operation. This plan must be correlated to Exhibit E - Map. The description of the <br />mining plan must be adequate to satisfy the requirements of Rule 3.1 and demonstrate <br />compliance with Rule 3. At a minimum, the Operator/Applicant must include the following <br />information: <br />(a) <br />If the operation is intended to be an intermittent operation as defined in C.R.S. 34-32- <br />103(6)(a)(I1), the Applicant should include in this exhibit a statement that conforms to the <br />provisions of Section 34-32-103(6)(a)(11), C.R.S.; <br />(h) <br />specify how much water will be used in conjunction with the operation, and the source of this <br />water; <br />Two ponds are depicted on the map. Please clarify if more than one pond will be open at one <br />time. <br />(17) Optional <br />Proposed site is larger than 5 acres, revise to state strips on 9.9 ac permit area <br />You have stated a maximum disturbance of 1.5 ac. Then later on you state that no more than 1 <br />acre will be disturbed. These should match. Maximum disturbance will include each mining <br />phase as well as processing areas and stockpiles. <br />Current permit assumes maximum disturbance of 2 acres, of which 1.15 is a mining phase and <br />0.85 ac of other areas (roads, ponds, operating areas). Proposed mining phases are 10,000 sq. <br />ft. largerthan the currently approved. You may wish to state that mining phases will be no larger <br />than 1.5 acres with a maximum disturbance of 2.5 acres which would be large enough to cover <br />processing areas, ponds, roads, etc. assuming there are no additional changes. <br />Mining map depict direction of mining north to south.
