Jennifer Lindahl, P.E. Page 4 of 8 <br />Bromley Lakes SWSP <br />April 3, 2017 <br /> <br />information at this time regarding the use of the five shares from 1986 to 2005. After 2005 RMCC started <br />using the five shares in SWSPs. A copy of the Report in case no. 2009CW279, dated June 2010 prepared by <br />Applegate Group (“Applegate”) was submitted to this office with the 2010 SWSP request. The June 2010 <br />Report describes the lands historically irrigated by the 5 Fulton Ditch shares as follows: 4.8 acres of 29 acres <br />at the Arends Farm (Section 14, T1S, R67W), which were irrigated by 5 of 30 shares now owned by RMCC. The <br />dry up area is within the Cell 3/Lot 1 area, which has an approved liner. <br /> <br />The average monthly farm headgate deliveries, total return flows and stream depletions extracted from 2010 <br />Report of the 30 shares are summarized in Table 3. As shown in Table 3 (columns 1 through 3) the Arends <br />Farm headgate deliveries average 84.76 acre-feet, total return flow averaged 31.93 acre-feet and net stream <br />depletions averaged 52.82 acre-feet per year. Therefore, for the purpose of this SWSP in order to determine <br />the HCU credits attributable to RMCC’s five shares for the period of 1950 through 1985 you used the depletion <br />pattern and return flow factors from the decree in ca se no. 2009CW279 and adjusted these values by 5/30th <br />or 1/6th of the values for the entire farm (columns 4 through 6 of Table 3).The decree in case no. 2009CW279 <br />relied on the Applegate Report regarding the HCU assumptions for the change of use of the 105 Fulton Ditch <br />shares. Although the Report determined the annual o n farm depletions for the 105 Fulton Ditch shares as <br />194.8 acre-feet, according to paragraph 8.4.4 of the decree in case no. 2009CW279 the historical net <br />depletions of the shares averaged 1.83 acre-feet per share (191.9 acre-feet). Therefore, the values in Table <br />3, columns 4 through 6 were multiplied by 98.5 percent (191.9/194.8) to account for the reduction in the <br />historical net depletions of the shares in case no. 2009CW279. In addition these values were again multiplied <br />by 69.7 percent (46/66 years) to account for the 20 years out of 66 years (1950 through 2015) of unknown use <br />of the 5 shares from 1986 through 2005. This resulted in an annual on-farm depletion of 1.20 acre-feet/share, <br />as shown on the attached Table 3. Based upon the decreed return flow factors, the historical farm headgate <br />delivery of the shares averaged 1.94 acre-feet/share and the return flows averaged 0.73 acre-feet/share. The <br />total farm headgate, return flows and net stream depletions associated with the RMCC’s five share used on <br />the Arends Farm are presented on the attached Table 3. <br /> <br />Based upon the above HCU analyses, RMCC’s 5 Fulton Ditch shares will yield 6.04 acre-feet in 2017 as <br />summarized below: <br /> <br /> RMCC’s 5 Fulton Ditch shares depletions (acre-feet) <br />*The April through October factors are applied to the daily farm headgate deliveries and the November <br />through March factors are applied to the prior year annual farm headgate deliveries <br /> <br />For the purpose of this SWSP the SEO has accepted the revised HCU analysis based on previous change case <br />no. 2009CW279 and based on the adjustment provided. <br /> <br />The City of Brighton will measure and deliver the 5 shares of Fulton Ditch water directly to the river (via <br />Brighton’s Fulton Ditch augmentation stations) or to storage at Kenneth Mitchell Lake, Erger Pond, or 124th <br />Storage Pond. RMCC will measure and report any deliveries of its shares to the river or storage via the Erger <br />Fulton Lateral. RMCC will measure the delivery of any shares to storage and also measure any release from <br />storage to the South Platte River.
