Page 5 of 8 <br />Bromley Lakes SWSP <br />April 3, 2017 <br /> <br />The balance of the replacement requirements of 46.3 acre-feet will be provided by a lease for augmentation <br />credits with the City of Brighton (“Brighton”). Table 1C, Column 29 shows the distribution of their respective <br />credits. A copy of the lease with Brighton was provided to this office with this SWSP request and is attached <br />to this letter. <br /> <br />The monthly evaporative depletions and proposed monthly replacement requirements can be found on the <br />attached Table 1C. As currently projected, the applicant will not have any depletions past March 31, 2018 <br />and therefore will not require subsequent SWSP approvals for this site. If the project operations are <br />prolonged so that depletions extend past March 21, 2018 the applicant must obtain a subsequent SWSP <br />approval so that all out-of-priority depletions are replaced. <br /> <br />Conditions of Approval <br /> <br />I hereby approve the proposed substitute water supply plan in accordance with C.R.S. §37-90-137(11), subject <br />to the following conditions: <br /> <br />1. This plan shall be valid from January 1, 2017 through March 31, 2018 unless otherwise revoked. If <br />this plan will not be made absolute by a water court action by the plan’s expiration date, a <br />renewal request must be submitted to this office with the statutory fee (currently $257) by <br />February 1, 2018. <br />2. As currently projected, the applicant will not have any depletions past March 31, 2018 and <br />therefore will not require subsequent SWSP approvals for this site. If the project operations are <br />prolonged so that depletions extend past March 31, 2018 the applicant must submit a renewal <br />request in accordance with Condition 1, above. <br />3. Well permit no. 76711-F was approved for the current use and exposed pond surface area of the <br />Bromley Lakes site in accordance with §37-90-137(2) and (11), C.R.S. Within 60 days of the <br />permanent end of exposure of groundwater in the pit, the applicant should submit a well <br />abandonment report for well permit no. 76711-F. <br />4. The total area of pond surface exposed for each of the pits shall not exceed those values listed in <br />Tables 1A & 1B of this approval. Should the total surface area exposed exceed those amounts, an <br />amendment will need to be filed with this office. <br />5. Total consumption at the Bromley Lakes site must not exceed the amounts listed in Tables 1A & 1B <br />of this approval unless an amendment is made to this plan. <br />6. Approval of this plan is for the purposes as stated herein. Any additional uses of this water must <br />first be approved by this office. Any future additional historic consumptive use credit given (e.g., <br />agricultural water transfer) for this site must consider all previous credits given. <br />7. All releases of replacement water must be sufficient to cover all out-of-priority depletions in time, <br />place, and amount and must be made under the direction and/or the approval of the water <br />commissioner. The release of replacement water may be aggregated to maximize beneficial use. <br />The water commissioner and/or the division engineer shall determine the rate and timing of an <br />aggregated release. <br />8. The replacement water, which is the subject of this plan cannot be sold or leased to any other <br />entity. As a condition of subsequent renewals of this substitute water supply plan, the replacement <br />water must be appurtenant to this site until a plan for augmentation is obtained. All replacement <br />water must be concurrent with depletions in quantity , timing, and locations. <br />9. Applicant shall follow the Augmentation Plan Accounting and Dry-Up Protocols for the operation of <br />this SWSP.
