Golden Gilpin mill as a tourist attraction (an industrial/commercial use) would be <br /> difficult if it were to be removed as part of the site reclamation. <br /> 5.2.3 Policy NOP-1.1 <br /> The City of Black Hawk is aware of the Golden Gilpin mill's status as a viable mineral <br /> processing facility. Policy NOR 1.1 describes the Golden Gilpin mill as "the Golden <br /> Gilpin Working Mill[sic]site... " <br /> 5.2.4 Policy CC-2.2 <br /> Under "Principle CC-2: Preserve,protect, and enhance the structures that represent <br /> historic, cultural, geographical, or architectural elements of the City's heritage", Policy <br /> CC-2.2 directs that the City shall "Retain historic structures in their existing/original <br /> location whenever possible to as not to destroy the historic structure's context. Built in <br /> 1934 and one of, if not the, last remaining example of historic milling,the Golden Gilpin <br /> mill certainly exemplifies the City of Black Hawk's self-acknowledged heritage and <br /> cultural as the "City of Mills" (City of Black Hawk Comprehensive Master Plan, pg. IV- <br /> 12, "Character of the Built Environment", attached as Exhibit D). <br /> 5.3 Current Land Use/Zoning <br /> On December 14, 2016, an application was submitted to the City of Black Hawk <br /> requesting verification of the current zoning of the land parcels upon which the Golden <br /> Gilpin mill is sited. These parcels (Parcel ID# 1833-072-01-22 and 1833-072-01-35) are <br /> located within the City of Black Hawk. The City's response was receiving on January <br /> 13, 2017, confirming the zoning of these parcels as "Environmental Character <br /> Preservation (ECP)". This is a current zoning designation, which replaced "Mining <br /> (M)" recently. The response from the City of Black Hawk, via it's representative <br /> Baseline Corporation is included in its entirety as Appendix E. <br /> 5.3.1 City of Black Hawk Municipal Code, Chapter 16 <br /> Chapter 16 of the City of Black Hawk Municipal Code, Version 2016, describes all <br /> regulations regarding zoning and land use. Environmental Character Preservation (ECP) <br /> is described thusly(Section 16-73): "The ECP zoning district shall replace all existing M <br /> zones as defined in the May 1991 zoning ordinance. This zoning district shall contain <br /> those areas which are considered to be of special significance for their unique natural or <br /> cultural importance in defining the character of the City or for the protection ofpublic <br /> health and safety. " Section 16-74 specifies the purpose of ECP zoning: "The purpose of <br /> the ECP zoning district is to preserve environmentally and culturally sensitive areas <br /> that are prominent features of the community, and protect public health and safety.
