Of note, Section 16-75 (Objectives) states: "The objectives of the ECP zoning district are <br /> to: ... (2)Protect distinctive features of the City's mining heritage, which are a cultural <br /> amenity to the community. " (Emphasis added) <br /> The use regulations for this zoning designations are described within Section 16-76. <br /> Mining and milling is a designated special review use: "(c) Special review uses. (3) <br /> Mining and mining related uses, including mining heritage uses, such as a mining <br /> museum which preserve the community's mining heritage, may be permitted ... " <br /> Chapter 16 of the City of Black Hawk Municipal Code is included herein as Appendix F. <br /> 6 Conclusion <br /> Central City Consolidated Mining Company and its President, Mr. George E. Otten <br /> desire and plan to leave intact all buildings, structures, equipment and mining and milling <br /> related supplies upon the properties owned and controlled by Mr. George E. Otten, post- <br /> reclamation. <br /> • This desire is congruent with the intended post-reclamation use specified in the <br /> originally approved DRMS permit("industrial/commercial") <br /> • This plan is congruent with the historic mining uses and character as described in <br /> its listing under the Central City/Black Hawk National Historic District. <br /> • This plan is congruent with the mining heritage and cultural character desired by <br /> the City of Black Hawk. <br /> • This plan is congruent and compliant with the current Environmental Character <br /> Preservation zoning as determined by the City of Black Hawk. <br /> The reclamation plan, as submitted and approved in 1990 shall remain the reclamation <br /> plan.
