Bifurcation: The Court entered an Order on May 6, 2015 bifurcating Case No. 12CW304 <br /> into two claims: an Augmentation plan claim and a Storage Right claim. Weld County <br /> continued as Applicant in the portion of the case involving the plan for augmentation for <br /> certain unlined cells associated with the mining of the Geisert Pit. The augmentation <br /> plan decree has been designated as Case No. 12CW304-B. The Court ordered that <br /> Central Colorado Water Conservancy District and the Groundwater Management <br /> Subdistrict of the Central Colorado Water Conservancy District join Weld County as Co- <br /> Applicants in the portion of the case involving the storage claim for that part of the <br /> Geisert Pit that has been lined and developed into a storage reservoir ("Geisert <br /> Reservoir"). The decree herein pertains to the claim for the storage water right in Geisert <br /> Reservoir,and has been designated as Case No. 12CW304-A. <br /> 3. Amended Application: The Court entered an Order on August 12, 2015 granting Co- <br /> Applicants' motion to amend the original application for the purpose of adding an <br /> alternate point of diversion, and to request an additional diversion amount of 15 cfs, in <br /> addition to the 40 cfs that was listed in the original application. <br /> 4. Publication and Statements of Opposition: The Application was published in the Water <br /> Division No. I resume of December 2012 applications. The Amended Application was <br /> published in the Water Division No. 1 resume of August 2015 applications. The <br /> following parties filed Statements of Opposition in a timely manner: the City of <br /> Thornton; Ogilvy Irrigating and Land Company; Northern Colorado Water Conservancy <br /> District; the City of Greeley, acting by and through its Water & Sewer Board; Cache la <br /> Poudre Water Users Association; and the City of Boulder. No other parties have filed <br /> statements of opposition and the time for filing statements of opposition has expired. <br /> 5. Notice and Jurisdiction. Timely and adequate notice of the Application and these <br /> proceedings has been given as required by law. The surface water involved herein is not <br /> included within the boundaries of any designated ground water basin. The Water Court <br /> has jurisdiction over the Application and the subject matter of these proceedings, and <br /> over all who have standing to appear as parties,whether they have appeared or not. <br /> 6. Purpose of Application. Weld County has operated a gravel pit(the "Geisert Pit")which <br /> has exposed groundwater that is tributary to the Cache la Poudre River. See Exhibit A, <br /> attached. A portion of the property will remain unlined and will continue to expose <br /> groundwater; depletions from which will be augmented pursuant to the augmentation <br /> plan entered by separate decree under the application in Case No. 12CW304-B.A portion <br /> of the Geisert Pit has been converted to a lined storage vessel and this application also <br /> includes a claim to adjudicate a water storage right for the Geisert Reservoir. The <br /> application has been bifurcated as noted above to address the separate claims and this <br /> decree adjudicates the storage rights claimed for the Geisert Reservoir. <br /> 7. Summary of Consultation. The Summary of Consultation with the Water Referee was <br /> held on March 21, 2013 and filed on March 31, 2013. <br />
