If Tenant has not corrected the default or breach or has not taken <br /> action reasonably likely to affect such condition within 30 days,default shall be deemed to have <br /> occurred. <br /> No Notice to Quit shall be issued until a default has occurred, either by failure to pay rent or <br /> breach and failure to cure said breach. Notice to Quit shall be served as required by Colorado <br /> law, Colorado Revised Statute 13-40-107,as revised from time to time. <br /> SECTION NINE <br /> BINDING EFFECT <br /> 9.1 The covenants and conditions contained in this Agreement shall apply to and bind <br /> the heirs,legal representatives,and assigns of the parties,and all covenants are to be construed ! <br /> as conditions of this Agreement. r <br /> I <br /> SECTION TEN <br /> GOVERNING LAW <br /> 10.1 It is agreed that this Agreement shall be governed by,construed,and enforced in <br /> accordance with the laws of the State of Colorado. <br /> i <br /> SECTION ELEVEN <br /> TIME OF THE ESSENCE <br /> 11.1 It is specifically declared and agreed that time is of the essence of this Agreement. <br /> SECTION TWELVE <br /> ATTORNEY FEES <br /> 12.1 In the event that any action is filed in relation to this Agreement,the unsuccessful <br /> party in the action shall pay to the successful party, in addition to all the sums that either party <br /> may be called on to pay,a reasonable sum for the successful party's attorney fees. <br /> SECTION THIRTEEN <br /> ENTIRE AGREEMENT <br /> 13.1 This Agreement is made and entered into on the date first set forth above and shall <br /> constitute the entire agreement between the parties. <br /> SECTION FOURTEEN <br /> MODIFICATION OF AGREEMENT <br /> 14.1 Any modification of this Agreement or additional obligation assumed by either <br /> party in connection with this Agreement shall be binding only if evidenced in a writing signed by <br /> each party or an authorized representative of each party. <br />
