E <br /> i <br /> a <br /> Scales shall be available for Landlord's use during normal business hours and without payment <br /> from Landlord. s <br /> 5.4 Tenant shall use the water provided by Landlord for the washing of material, <br /> processing of concrete and mitigation of dust as efficiently as reasonably possible. <br /> SECTION SIX <br /> HOLDOVER BY LESSEE <br /> 6 <br /> 6.1 Should Tenant remain in possession of the demised premises with the consent of <br /> Landlord after the natural expiration of the term of this Agreement,a new one-year teen shall be <br /> created between Landlord and Tenant which shall be subject to all the terms and conditions of <br /> this Agreement. <br /> SECTION SEVEN <br /> SURRENDER OF PREMISES § <br /> 7.1 At the expiration of the term, subject to the mining,quarrying and removal of <br /> materials as herein provided,Tenant shall quit and surrender the demised premises in as good <br /> state and condition as they were at the commencement of this Agreement,reasonable use and <br /> wear and damages by the elements excepted. <br /> 7.2 Tenant shall be responsible for reclamation and the expense thereof of the areas of <br /> the Premises it has mined or disturbed or that were mined or disturbed by LCI. Tenant agrees to i <br /> make separate stock piles of top soil,overburden,and waste materials. Tenant agrees that on F <br /> completion of each phase of operation and upon completion of all such operations, or upon f <br /> termination of the Agreement(if requested by Landlord),Tenant will place unused substances, <br /> top soil and overburden back over the excavated areas and spread such reclamation material <br /> evenly over the excavated embankments. Tenant may desire to or may be required to present <br /> appropriate government units with a plan(s)of reclamation. Landlord agrees to execute any <br /> addendum to this Lease regarding reclamation that may be desired or required by appropriate <br /> government units or in order to obtain the permits required for the operations as set forth herein. <br /> Tenant shall have the time permitted by the appropriate government agency to complete <br /> reclamation in accordance with the reclamation plan approved by such government agency. <br /> SECTION EIGHT <br /> DEFAULT <br /> 8.1 If any default is made in the payment of rent, or any part of the rent, at the times <br /> specified in this lease, or if any default is made in the performance of or compliance with any <br /> other term or condition of this lease,the lease, at the option of Landlord,shall terminate and be <br /> forfeited, and Landlord may remove all persons from the Premises. Tenant shall be given 3 days <br /> written notice of any default or breach of failure to pay rent. Termination and forfeiture of the <br /> lease shall not result if,within such 3 days'notice period, Lessee has corrected the default or <br /> breach. <br /> I <br />
