King Coal Mine (C-1981-035) TR-26 Adequacy Review #2 Response

Text from your August 31, 2016 document is reprinted below. The following adequacy
items are numbered to correspond to the initial items from the Division’s first adequacy
letter dated November 25, 2015. A large portions of the text from the first adequacy letter
and from the GCCE response are not repeated here. This was intentionally done to focus
attention on the required tasks moving forward. Responses by GCC Energy are shown in
underlined italics.

1. DRMS August 31, 2016: No further response required.

2. DRMS August 31, 2016: No further response required.

3. DRMS August 31, 2016: Other than submission of the “Natural Resources Survey”, no further
response required.

GCCE October 18, 2016: The “Natural Resources Survey” for the monitoring well sites will be attached as
Appendix 8(6) when received by GCC Energy. The field work for this study was recently completed by Ecosphere
Environmental Services and a final report is expected within approximately two weeks from today. No drilling or
surface disturbance will take place prior to submittal of this report and its acceptance by the Division.

4. DRMS August 31, 2016: No further response required.

5. DRMS August 31, 2016: No further response required.

6. DRMS August 31, 2016: The Division approves the proposed locations of additional monitoring
points. The list of analytes proposed by GCCE (tables in proposed Section 2.05.6) is sufficient. No
further response required.

7. DRMS August 31, 2016: No further response required.

8. DRMS August 31, 2016: Additional information in the PAP is needed regarding management
practices (BMPs) for erosion and sediment control for the drill pads. This should be discussed in
the PAP text and a note added to the design (Appendix 4(4)) stating that wattles or other BMPs
will be field fit. (The new location of Cluster MW-4 appears to make this issue more important
than prior to the change in location.)

GCCE October 18, 2016: Section 2.04.6 of the PAP text has been revised to include best management practices
(BMPs) for erosion and sediment control for the drill pads. Also, a note has been added to the design (Appendix
4(4) stating that wattles or other BMPs will be field fit.

9. DRMS August 31, 2016: No further response required.

10. DRMS August 31, 2016: No further response required.

11. DRMS August 31, 2016: No further response required.

12. DRMS August 31, 2016: No further response required.

13.
