Publication in <br /> the Longmont Times Call started on July 8, 2016 and ended on <br /> July 29, 2016 . The public comment period ended on August 18, <br /> 2016 . <br /> A copy of the return receipt cards, or proof of mailing and <br /> USPS tracking printout if a green card was not returned, are <br /> attached for your file . We mailed second notices to Kinder <br /> Morgan since the first notice was returned from the address <br /> obtained from the Colorado Oil and Gas Commission records . <br /> Any letters from other commenting agencies/entities received by the Division to date have been included with this <br /> correspondence for you to review. <br /> OFFICE OF ARCHAEOLOGY&HISTORIC PRESERVATION - We will follow their sugges- <br /> tions if human remains are found. <br /> OFFICE OF THE STATE ENGINEER - L.G. Everist, Inc . understands the <br /> requirement for updating our Substitute Water Supply Plan and <br /> well permit if there is an increase in water use . <br /> PDC ENERGY -As noted in their letter L.G. Everist is working <br /> closely with PDC Energy and expect to have an agreement in <br /> place for the new area. All PDC structures within 200-feet of <br /> the existing permit area are covered by an agreement on file <br /> with the Division. (PDC bought out Merit Energy, the original <br /> company listed on the 2001 agreement . ) This leaves the 2 wells <br /> on the south side of Area C and a portion of the flow lines <br /> from those wells to their tank area on the existing mine site <br /> that are not covered by an agreement . On September 23 , 2016 <br /> PDC Energy withdrew their objection and L.G. Everist, Inc . <br /> will continue to work with them on an agreement . <br /> MR. &MRS. LOHMANN - Three concerns were raised by the Lohmann' s in <br /> their objection letter - dust, weeds, timing. <br /> Lynn Mayer Shults of L.G. Everist spoke with Mr. Ted Lohmann <br /> and addressed all of his concerns . See information below. The <br /> Lohmanns have withdrawn their objection. <br /> DUST- This issue is not technically under the Division' s juris- <br /> diction, however, we would like to explain to the Division <br /> that L.G. Everist is in compliance with their Air Permits for <br /> this mine. Dust control methods are used as required and <br /> include the use of water sprays in processing equipment, on <br /> roads and disturbed areas, revegetation on growth medium <br /> stockpiles, and graveling of roads . <br />
