PAGE 3 <br /> OCTOBER 1 1 , 20 1 6 <br /> EXHIBIT S - Permanent Man-Made Structures (Rule 6.4.19): Please note that roadways and aboveground or <br /> underground utilities (if present)within 200 feet of the proposed affected area are considered permanent <br /> man-made structures. In accordance with Rule 6.4.19, when mining operations will adversely affect the <br /> stability of any significant, valuable and permanent man-made structure located within 200 feet of the <br /> affected area, the applicant may either: <br /> a.) Provide a notarized agreement between the applicant and the person(s) having an interest in the <br /> structure, that the applicant is to provide compensation for any damage to the structure; or <br /> b.) Where such an agreement cannot be reached, the applicant shall provide an appropriate engineering <br /> evaluation that demonstrates that such structure shall not be damaged by activities occurring at the mining <br /> operation. <br /> Please provide evidence (certified letter to structure owners) that a notarized agreement between all <br /> structure owners listed in the application and the applicant was pursued If an agreement is unable to be <br /> reached a geotechnical assessment may be provided to demonstrate that the structures shall not be <br /> damaged. You must provide information sufficient to demonstrate that the stability of any structures <br /> located within two hundred (200) feet of the operation or affected land will not be adversely affected. <br /> As noted in the application packet, the Division has copies of <br /> structure agreements for 8 of the 25 structure owners around the <br /> mine . We have recently received new signed and notarized agree- <br /> ments from Harold & June Hall, Pasquale Varra, and Dolores French <br /> (copies attached) . <br /> As mentioned above, Kinder Morgan and Colorado Interstate Gas <br /> representatives called L.G. Everist to inform them that they no <br /> longer own gas lines on the permitted property. Their lines are <br /> now owned by DCP Midstream (Duke) . L.G. Everist already has a <br /> structure agreement with Duke. The permit maps have been cor- <br /> rected to reflect the ownership changes . <br /> Attached are copies of the mailing receipts showing that we <br /> mailed 17 structure agreements to the owners on July 15, 2016, <br /> where none existed prior to permitting. Copies of any agreements <br /> received in the future will be provided to the Division for the <br /> permit file . <br /> We contacted Deere & Ault to prepare a slope stability analysis <br /> as an acceptable option for any structures within 200-feet for <br /> which we do not get structure agreements . Deere & Ault ' s analy- <br /> sis shows the setback distances for the closest structure on all <br /> 4 sides of the amendment area will be safe during and after <br /> mining for the entire permit area. We have attached a copy of <br /> October 7, 2016 , Carbon Valley Gravel Mine Slope Stability Analy- <br /> sis, prepared by Deere & Ault, for your review. <br />
