The soil pile at the west end of the permit and the east of <br />Containment #1 is marked as such but not indicated on Map 14. <br /> <br />ROADS Rule 4.03, <br />Construction 4.03.1(3), 4.03.2(3); Drainage 4.03.1(4), 4.03.2(4); <br />Surfacing and Maintenance 4.03.1(5) and (6) 4.03.2(5) and (6). <br />o The roads into and around the facility were inspected. Some <br />road sections require grading (road to RDA), however overall it <br />appears the operator maintains roads in good working order. <br />o Mr. Zuber in the June 2016 inspection report recommended the <br />placement of sediment control structures at the toe of fill slopes on this <br />road. <br />o Water trucks were observed being filled with pumpage from Pond 6. Although not observed, <br />evidently road watering was taking place with this pumpage in order to reduce Pond volumes. <br /> <br />SUPPORT FACILITIES- Rule 4.04: <br />o Support facilites were idle as the mine is not currently operating. <br />o The slurry injection system remains in place but is not in use at this time. <br />o The repair of sediment control BMP’s at the upper water tanks appeared to be functioning <br />adequately at the time of inspection. <br />o Underground mining equipment is stored on the west end of the facilities area. It appears that <br />water routing between the stream buffer zone perimeter berm around the facilites area directs <br />water to ditch D15 and ultimately Pond 007A. <br />o Facilities observed at New Elk site at the time of inspection appeared in good repair, neat and <br />orderly with the exception of: <br />7. Coal refuse and fines under the conveyor should be removed to the RDA to prevent movement <br />offsite as pointed out in previous inspections. <br /> <br />SUPPORT FACILITIES OFFSITE- Rule 4.28: <br />The Jansen loadout was inspected. Visible signs of <br />vandalism and damage were observed. A tree had <br />recently fallen (the leaves Still green at the time of <br />inspection) across theconveyor. No erosion was <br />observed at the loadout. However, the following <br />issues were noted: <br /> <br />8. Coal residue remained at both ends of the <br />conveyor system. Mr. Zuber pointed this out in the <br />June 2016 inspection and requested that this be <br />removed to avoid material transport during runoff. <br />9.
