FI , <br /> Transit Mix Concrete Co. <br /> Wildfires <br /> Objector Comment: Any industrial activity in this area increases the risk of wildfire, which is the <br /> number one threat to the people and properties along SW Highway 115. Sparks from blasting, <br /> metal touching rock, metal touching metal, rock hitting rock, and heavy equipment will increase <br /> the risk of a wildfire. The right mix of drought, fuel, wind, and sparks will start a fire that cannot <br /> be controlled. It is interesting that Transit Mix's application addresses hurricanes in the <br /> Emergency Action Plan but does not address wildfires. <br /> Response: As typical with mining operations, the operator will pre-strip material in advance of <br /> mining to remove trees, grasses, shrubs and all other material. Additionally, the operator will be <br /> watering the haul routes and areas of operations. The equipment at the crushing and screening <br /> area will be equipped for water sprays. Pre-stripping the vegetal material eliminates the fire <br /> potential in the mining area. <br /> Transit Mix is preparing a Wildfire Management Plan, which will be included in the El Paso County <br /> Special Use Permit application. Transit Mix has also made commitments to the local fire and <br /> emergency authority that all operators will be trained in wildland fire fighting and will respond if <br /> requested to do so by the local authority. Equipment will be made available in case of emergency <br /> and it is intended that water delivery tankers will be left full overnight, weather dependent, to <br /> assist local fire crews. <br /> Access Road Easement <br /> Objector Comment: Exhibit C of the permit application does not show the existence of the Little <br /> Turkey Creek Road ingress/egress easement which is owned by landowners within Eagle Nest, as <br /> required by Rule 6.4.3(g). Closing the road for blasting operations will be a breach of the <br /> easement agreement. <br /> Response: The Little Turkey Creek Road location is shown on Figure C-2 of Exhibit C in the July <br /> 21, 2016 permit submittal. Transit Mix has provided a legal opinion prepared by Cory Rutz of <br /> Otten Johnson in Exhibit N of the July 14, 2016 permit submittal. This opinion demonstrates that <br /> Colorado law permits "reasonable" interference with passage along the road and that the <br /> planned closures for blasting operations are a reasonable interference. Transit Mix is committed <br /> to maintaining up-to-date information on the blasting schedule to help landowners plan their <br /> trips along Little Turkey Creek Road.
