3 <br />2.04.8 Baseline Climatological Information <br />Permit section 2.04.8 presents climate information. <br />This section of the rules is adequately addressed in the permit. <br />2.05.3 (4) a -d Operations Plan - Permit Area <br />This is a review of the permit requirements for, general and detail design plans for, sediment ponds, <br />impoundments and other diversions proposed in the permit. <br />Permit section 2.05.3(4) provides discussion of ponds and other diversion structures. Maps 2.05.3(4)-1, <br />2.0.5.3(4)-6, (4)-7, (4)-9, and (4)-10 provide location information and as built details for, ponds NHN-001 and <br />NHN- 002 as well as the associated North and South ditches. Appendices 2.05.3(4)-7, 2.05.3(4)-8, and 2.05.3(4)- <br />10, and present the SEDCAD model results for, ponds and ditches. <br />This section of the rules is adequately addressed in the permit with the exception of: <br />11. Please identify the red crosshatched area in the legend of Map 2.0.5.3(4)-9 and submit the <br />updated map to DRMS. (Rule 2.10) <br />12. Please call out in each detail box of maps 2.0.5.3(4)-6, (4)-7, (4)-9 and (4)-10; the map scale <br />(e.g. lin = 60 ft). (Rule 2.10) <br />2.05.4 Reclamation Plan <br />Permit section 2.05.4 (Reclamation Plan) adequately addresses this rule. <br />2.05.6 Protection ofHydrolozic Balance. Mitigation oflmpacts <br />The permit as per sections 2.04.5, 2.04.7 (Hydrology Description), Appendix 2.04.7-2 (Water Quality Monitoring <br />Data) and associated maps 2.04.5-1, and 2.04.7-1, and section 2.05.6(3) (Protection of Hydrologic Balance) <br />adequately addresses this rule with the exception of. - <br />13. <br />f:13. Page 5 of Permit Section 2.05.6(3) states that ponds and diversions "will be removed and <br />reclaimed....". Please, either direct the DRMS to the section in the permit that discusses how <br />this type of infrastructure will be removed and reclaimed or, add this information to the <br />appropriate section of the permit and submit revised pages to the DRMS while referencing its <br />location in the discussion on page 5. <br />14. Page 7 of this section states that surface water monitoring installations ... will be <br />removed.... Please, either direct the DRMS to the section in the permit that discusses how this <br />type of infrastructure will be removed and reclaimed or, add this information to the appropriate <br />section of the permit and submit revised pages to the DRMS while referencing its location in the <br />discussion on page 7. <br />15. Page 17 of the above referenced permit section refers to 1997 NOAA evaporation rates for, semi <br />and climates. Please update this page and submit to DRMS if available, a more current NOAA <br />evaporation rate for, semi -arid climates. <br />16. Page 19 of the above referenced permit section refers to effluent requirements specified in the <br />NPDES Permit. Please cite, in this paragraph where the NPDES Permit resides in the permit <br />document and send revised page to the DRMS. <br />17. Page 23 of the above referenced permit section refers to Figure 2.05.6(3)-1 and uses terminology <br />(Dakota Sandstone, low wall and dryland pasture) that does not appear on the figure. Please <br />utilize the same terminology on the figure as used in the discussion and update the figure as <br />needed. Also, show on the figure the direction of mining and resubmit the figure as a revised <br />New Horizon North Permit Revision PR1 Prepared by: R.
