Ruling and Decree <br /> Case No.2009CW271 <br /> City of Longmont <br /> uses of the Longmont Coffin Davis Right, as changed in this Ruling and Decree. <br /> B. Coffm Davis-Union Reservoir Exchange. <br /> i. Upstream terminus. The upstream terminus of the Coffm Davis- <br /> Union Reservoir Exchange is Union Reservoir,the outlet of which is located at a point on Spring <br /> Gulch in the NW%NE% of Section 6, Township 2 North, Range 68 West, 6th P.M., Weld <br /> County, Colorado, approximately 660 ft south and 2230 ft west of the northeast corner of Section <br /> 6. <br /> ii. Downstream terminus. The downstream terminus of the Coffin <br /> Davis-Union Reservoir Exchange is at the confluence of Spring Gulch and St. Vrain Creek, in <br /> the NE'/ SE% of Section 7, Township 2 North,Range 68 West, 6th P.M.,Weld County, <br /> Colorado, approximately 840 ft west and 1960 ft north of the southeast corner of Section 7. The <br /> exchange reach is depicted on the attached Exhibit A. <br /> iii. Rate. 17.3 c.f.s., conditional. <br /> iv. Source of replacement water. The Longmont Coffm Davis Right, <br /> as changed in this Ruling and Decree, and more fully described in Paragraphs 6 through 8 above. <br /> v. Date of appropriation. December 30, 2009,on which date there <br /> was a concurrence of intent to appropriate and overt acts in furtherance of such intent, including, <br /> without limitation, the filing of the Application. <br /> vi. Use. The water diverted by exchange shall assume the decreed <br /> uses of the Longmont Coffin Davis Right, as changed in this Ruling and Decree. <br /> C. Notice to Water Commissioner. Prior to operating the exchange(s) <br /> decreed in this case, Longmont shall notify the Water Commissioner of the amount of the <br /> exchange(s),the source(s) of substitute supply, the location(s)of the delivery of the substitute <br /> supply and the duration of the proposed exchange(s). Longmont shall not operate the proposed <br /> exchanges without the prior approval of the Water Commissioner. <br /> D. Live stream. The exchanges decreed herein shall only occur during <br /> periods of a continuous live stream, as determined by the Division Engineer,between the <br /> upstream and downstream termini of the applicable exchange, and is limited to no more than the <br /> minimum amount of stream flow existing between the point of delivery of the substitute supply <br /> to the surface stream and the point where water is withdrawn from the surface stream. <br /> E. Transit loss. The exchanges described above may be subject to transit loss <br /> charges if determined necessary by the Division Engineer or Water Commissioner to prevent injury <br /> 17 <br />
