Ruling and Decree Case No.2009CW271 City of Longmont to other water rights. F. Quality of Substitute Water Supply. The substitute supply shall be of a quality and continuity to meet the requirements of use to which the downstream senior appropriator has normally been put. G. Priority. The exchanges decreed in this case shall be exercised within the priority system. V. Adjudication of surface water right. Longmont adjudicates the following new water right: 14. Name of structure. Coffin Davis Ditch, Sherwood Enlargement. 15. Legal description of point of diversion. At the existing decreed alternate point of diversion for the Coffin Davis Ditch, located in the SW1/4 of Section 7, Township 2 North, Range 68 West, 6th P.M., Weld County, Colorado, at a point commencing at the SW corner of Section 7,whence the West one-quarter corner of said Section 7 bears North 00°00'00"East,thence North 88°03'49"East 999.07 feet to the point of diversion, as depicted on the attached Exhibit B. 16. Source. Dry Creek, tributary to St. Vrain Creek. 17. Date of appropriation. December 22, 2009,on which date there was a concurrence of intent to appropriate and overt acts in furtherance of such intent, including, without limitation,the Longmont City Council's approval of a resolution of intent to appropriate. 18. Amount claimed. 17.3 c.f.s., conditional. 19. Use. Recreation, fish and wildlife propagation, wetland propagation, and irrigation within the Project Property located in Sections 7, 8, 9, 17, & 18, Township 2 North, Range 68 West,Weld County, Colorado. 20. Other. Longmont may divert the Coffin Davis Ditch, Sherwood Enlargement at any time of the year, when available in priority. VI. Additional Terms and Conditions. Longmont's use of the water rights changed, adjudicated and augmented pursuant to this Ruling and Decree shall be subject to the following additional terms and conditions: 21.
