Ruling and Decree <br /> Case No.2009CW271 <br /> City of Longmont <br /> meet the requirements for which the water has been used by senior downstream appropriators, <br /> and therefore meet the requirements of§ 37-92-305(5), C.R.S. <br /> E. Curtailment by State Engineer. Pursuant to §37-92-305(8), C.R.S., the <br /> State Engineer shall curtail all out-of-priority diversions, the depletions from which are not so <br /> replaced as to prevent injury to vested water rights. <br /> 12. No injury. The changes of water right and plan for augmentation adjudicated <br /> herein will not result in injury to any vested water rights or decreed conditional water rights, <br /> provided that the use of the water right changed herein and the operation of the subject plan for <br /> augmentation are made in compliance with the terms and conditions described herein. See § 37- <br /> 92-305(3), C.R.S. <br /> IV. Adjudication of appropriative rights of exchange. <br /> 13. Description of exchanges. Longmont adjudicates the following appropriative <br /> rights of exchange: <br /> A. Coffin Davis-St. Vrain Creek Pump Station No. 1 Exchange. <br /> i. Upstream terminus. The upstream terminus of the Coffm Davis-St. <br /> Vrain Creek Pump Station No. 1 Exchange is the St. Vrain Creek Pump Station No. 1,with an <br /> inlet located at a point on the North bank of St. Vrain Creek approximately 1,680 feet south and <br /> 1,010 feet west of the NE corner of Section 10, Township 2 North, Range 69 West, 6th P.M., <br /> Boulder County, Colorado. <br /> ii. Downstream terminus. The downstream terminus of the Coffin <br /> Davis-St. Vrain Creek Pump Station No. 1 Exchange is at the confluence of Dry Creek and St. <br /> Vrain Creek, in the NW 1/4 SE 'A of Section 7, Township 2 North, Range 68 West, 6th P.M., Weld <br /> County, Colorado, approximately 2,490 feet west and 1,710 feet north of the southeast corner of <br /> Section 7. The exchange reach is depicted on the attached Exhibit A. <br /> iii. Rate. 12 c.f.s.,conditional. <br /> iv. Source of replacement water. The Longmont Coffin Davis Right, <br /> as changed in this Ruling and Decree, and more fully described in Paragraphs 6 through 8 above. <br /> v. Date of appropriation. December 22, 2009, on which date there <br /> was a concurrence of intent to appropriate and overt acts in furtherance of such intent, including, <br /> without limitation, the Longmont City Council's approval of a resolution of intent to appropriate. <br /> vi. Use. The water diverted by exchange shall assume the decreed <br /> 16 <br />
