Mulliken Weiner Berg & Jolivet P.C. <br /> Ms. Amy Eschberger <br /> Mr. Wally Erickson <br /> April 18, 2016 <br /> Page 3 <br /> provide more detailed information about the proposed land to be mined if you can provide us <br /> with lawful access to do so. <br /> While in Colorado we value mining and making productive use of our natural resources, <br /> certainly there are other areas where granite can be found and extracted without destroying <br /> permanently a very unique, precious and valued environment. Per Section 34-32.5-102 of the <br /> Colorado Land Reclamation Act for the Extraction of Construction Materials, it is also a goal <br /> that we "conserve natural resources, aid in the protection of wildlife and aquatic resources, <br /> establish agricultural, recreational, residential, and industrial sites, and protect and promote the <br /> health, safety, and general welfare of the people of this state." Denying this Application would <br /> be consistent with those goals and values. <br /> Impacts to Residents of the Area <br /> Mrs. Ingersoll currently lives on the Ingersoll Ranch, as does the caretaker for the Ranch and <br /> his family. They would be impacted by the proposed quarry. Significantly, the area where the <br /> quarry is proposed is significantly inhabited already. The proposed quarry site sits in the middle <br /> of several well established residential areas, which are close to the quarry and will be directly <br /> and negatively impacted by it as more particularly explained in the letters you have received <br /> from neighbors to the proposed site. They are: <br /> • Little Turkey Creek Neighborhood has eight residences many of which are less than <br /> 1,900 feet or 3/8ths of a mile from the excavation. <br /> • Red Rock Valley has 83 residences,just north of Little Turkey Creek Road. <br /> • Eagles Nest has 36 lots and 16 residences west of the quarry. These owners are subject to <br /> the blasting, dust noise, wildlife impacts and potential water impacts and in addition, they <br /> must drive through the quarry daily to access their homes. <br /> • Bauer's Ranch has 13 properties west of the North Pit and the North Pit Extension and its <br /> owners must endure the same impacts as those in Eagle's Nest listed above. <br /> Suffice it to say that the area proposed for mining is located adjacent to and in close proximity to <br /> many residential homes, all of which would be adversely impacted by the noise, dust, traffic and <br /> visual impacts associated with this proposed mining activity. This is an area not appropriate for <br /> mining. <br /> Adverse Impacts to Wildlife <br /> The proposed quarry would significantly adversely impact the area's unique wildlife that <br /> the surrounding land supports.
