N <br />worst case discharges are not expected to be reached based on past discharges; therefore, the medium salinity <br />hazard is not expected to be achieved. <br />The Findings documents related to Permit Renewals 06 and 05 dated December 2014 and May 2009 respectively, <br />discuss implementation of Rule 4.05.2(6). <br />This section of the rules is adequately addressed in the permit. <br />Rule: 4.05.2(7) Compliance with the Water Ouality Control Act <br />This is a review of the rules regarding how the permitee complies with water quality regulations. <br />Exhibit 34, Dissolved Solids Estimates for the Williams Fork and the Yampa Rivers, and Exhibit 26 the Water <br />Quality Monitoring Manual describe monitoring activities and associated data collection procedures, provide <br />maps of monitoring locations and present water quality data. <br />Depending on mining activity and monitoring data, the mine may follow either an active mining monitoring plan <br />or a temporary cessation (TC) monitoring plan (Appendix D). The active mining monitoring plan is designed to <br />identify changes in the hydrologic system. The TC plan is a reduced version of the active mining plan. The TC <br />plan is designed to identify any change in the hydrologic system that could result in a change in impact to the <br />hydrologic balance. <br />The Water Quality Control Division through NPDES permit CO 0034142 establishes effluent limits and stream <br />standards. The permitee demonstrated compliance with these standards. <br />This section of the rules is adequately addressed in the permit. <br />Rule: 4.05.2(8) Treating Water Discharged from Disturbed Areas <br />This is a review of the rules regarding the installation and maintenance of facilities for treating water discharged <br />from the disturbed area. <br />Mine water and surface runoff are handled in a series of ditches and ponds. Williams Fork Mines No. 5 Mine <br />water and No. 6 Mine water is collected in a mine sump, pumped to the surface and pumped into a series of ponds <br />along the Williams Fork River, and then is discharged into the Williams Fork River. Disturbed area drainage is <br />controlled by ponds, except for those areas where small area exemptions have been approved. <br />This section of the rules is adequately addressed in the permit. <br />Rule 4.05.3 Diversion and Overland Flow in Small Watersheds <br />This is a review of rules 4.05.3(1-7) associated with diversion location, design, construction and reclamation. <br />Flow diversion are addressed in section 2.05 of the permit document and in TR14-36. Map 26 shows temporary <br />diversion ditches, and exhibit 18 provides specifications. There exist an upland clean -water diversion that <br />intercepts and routes upslope runoff to the livestock pond spillway as well as two temporary diversions. MCM <br />provided information on contingency diversions, which would be constructed in the event of an emergency. <br />This section of the rules is adequately addressed in the permit. <br />Rule: 4.05.4 (1-4) Stream Channel Diversions <br />This is a review of rules 4.05.4(1-4) associated with stream relocation and reclamation. <br />The Findings documents related to Permit Renewals 06 and 05 dated December 2014 and May 2009 respectively, <br />discuss implementation of Rule 4.05.(4).
