5 <br />be graded to blend into the natural topography and seeded with the pastureland (hayland) seed mixture or drill - <br />seeded with a cover crop and then the rangeland/wildlife seed mixture depending on their location as per the <br />Reclamation Plan Map (Map 29). <br />This section of the rules is adequately addressed in the permit. <br />Rule: 4.05.2(3) Exemptions <br />This is a review of the rules relating to exemptions and variances granted. <br />The Drainage and Sediment Control Map (Map 26) shows areas not included in the sediment control system <br />where variances have been requested as per the above rule. Exhibit 18 of the permit details these areas. <br />This section of the rules is adequately addressed in the permit. <br />Rule: 4.05.2(4) Small Area Exemptions <br />The Findings documents related to permit renewals 06 and 05 dated December 2014 and May 2009 respectively, <br />discuss implementation of Rule 4.05.4. Exhibit 18 in the permit application describes the erosion control <br />measures and provides design drawings and calculations for the structures. The Drainage and Sediment Control <br />Map (Map 26) snows areas not included in the sediment control system where variances have been requested. <br />The drainage system meets the effluent limitations of 4.05.2 and applicable State and Federal water quality <br />requirements for receiving waters. <br />This section of the rules is adequately addressed in the permit. <br />Rule: 4.05.2(5) Sediment Pond Construction <br />This is a review of the rules relating to location of sediment pond construction. <br />Sediment Pond designs are found in Exhibit 18 of the permit document. This exhibit comprises numerous <br />drawings, SedCad runs and summary information. The reclamation plan Section 2.05.4 of the permit addresses <br />sediment pond maintenance. The ponds are designed to handle a 10 year 25 hour event as required by this rule. <br />This section of the rules is adequately addressed in the permit with the exception of: <br />1. Exhibit 18 states that during a pond evaluation by Leonard Rice Consulting Water Engineers, Inc., <br />that it was not possible to determine the volume and detention time of ponds 9-P2 and 9-P3. Please <br />provide this information or indicate where in the permit this information can be found. <br />2. For all existing ponds please update the pond summary information on page 22 of Exhibit 18 to <br />provide information on: <br />a. Crest Elevation <br />b. Spillway Crest Elevation <br />c. Spillway Crest Lengh <br />d. Spillway Head and Freeboard <br />Rule: 4.05.2(6) Effluent Limitations with Respect to Miring of Drainage <br />This is a review of the rules regarding mixing drainage from disturbed and undisturbed areas. <br />Underground mine discharge from those mines, combined with spoil spring discharge from the Strip Pit, will <br />increase dissolved solids concentration in the Williams Fork River. During low flow of the river and assuming <br />worst case mine discharges, the concentration will increase by 224 mg/1, from the historical mean of 332 mg/l to <br />576 mg /1. SAR will increase from the historical mean of 0.44 to 5. 05. The Williams Fork River would have a <br />medium salinity hazard during low flow, and would have a low to moderate sodium hazard at other times.
