Reponse: CDRMS previously approved all ditch and culvert designs and as -built certification <br />for haul road at the Carbon Junction Mine in the approval of the mining and reclamation plan <br />and/or subsequent revisions to the mining and reclamation plan. To the best of our knowledge, <br />all information regarding haul road design in included in Appendix 5.1 and subsequent <br />correspondence in the Division's files. Information regarding sediment control ditch and culvert <br />designs in within Appendices 5-2, 5-9/10, and 5-12, Division files, and submitted reports, and <br />the permit document. <br />H. DBMS Jan 2016 Sections three and four of Rule 2.06 are not adequately addressed or <br />referenced in the abridged permit. <br />Please address these two sections of Rule 2.06 in the abridged permit by submitting <br />information to update the abridged permit treating the subjects of steep slope mining and <br />variances from approximate original contour as per Rule 2.06. <br />Response: We are confused as to the request within this comment. In a subsequent comment <br />this document states: <br />"K. DRMS Jan 2016 DRMS finds that the operator has adequately complied with the terms of the <br />approved variances [steep slope and approximate original contour]. All reclamation has been <br />carried out and the variance is no longer necessary. " <br />As any mining and reclamation has been long completed, and 9.5 years have passed without <br />issue as to the stability of the backfill, this comment would appear unnecessary. <br />L DRMS Jan 2016 Reviewing Appendix 5-13 as Fled in DRMS's content management system <br />DRMS staff discovered an 3 September 2014 letter regarding retention of features at the <br />Carbon Junction Site. It appears that this may be misfiled. <br />Please inform DRMS if this is indeed misfiled, <br />Please resubmit this letter as revised pages indicating the appropriate section of the <br />abridged permit where this information should reside, if it is misfiled. <br />Response: Without observing the file, we cannot comment on the Division's file contents or <br />misfiling. The approved table of contents for PRO1 (latest revision) identifies Appendix 5-13 as <br />containing the Landowner Request for Retention of Certain Features Post -Mining. <br />Reclamation Bond Calculation <br />Task 001: Revegetation of Disturbed Area (Fertilizing). No fertilizer was employed during <br />the revegetation of the Carbon Junction Mine. This is a task over and above the reclamation <br />tasks employed at the mine and associated costs should be removed from the reclamation bond <br />calculation. <br />Task 002: Borehole Seal Work. With Division approval of PRO1, wells PW -1 and 95-1 were <br />approved for retention post -reclamation and were permitted by the Division of Water Resources <br />as residential water wells. The permits and appurtenant paperwork were submitted to the <br />Division for documentation. As is Division policy, wherever a feature is no longer required to be <br />41Pa-e <br />
