VI. PAYMENT OF TAXES <br />Lessor agrees to pay all real estate taxes levied against the leased premises before the <br />same become delinquent. In the event that the Lessor fails to pay such taxes, Lessee may, at its <br />option, pay any such taxes and assessments as may be levied against the premises and deduct the <br />amount of such payments, together with any penalties or interest required to be paid, from the <br />amount thereafter due to Lessor hereunder. In the event Lessor's annual real estate taxes <br />increase as the result of Lessee's operations hereunder, Lessor and Lessee shall share equally in <br />the payment of any such increase. <br />VII. REMOVAL OF IMPROVEMENTS AND EQUIPMENT <br />All improvements and equipment placed on the leased premises by Lessee, except fences, <br />gates, and cattle guards, shall remain the property of Lessee, and Lessee shall have the right to <br />remove such property prior to the expiration of this Lease so long as no monetary defaults exist. <br />On termination of this Lease for any cause other than nonpayment of royalties or annual <br />minimums hereunder, Lessee shall have the right • to remove all such improvements and <br />equipment within one hundred twenty (120) days from the date of termination except fences, <br />gates, and cattle guards. If the Lease is terminated for the non-payment of royalties or annual <br />minimums, upon payment by Lessee of any delinquent royalties or annual minimums, Lessee <br />shall then have the right to remove all such improvements and equipment within sixty (60) days <br />thereafter, except fences, gates, and cattle guards. Lessee shall have one hundred twenty (120) <br />days from the date of termination to remove any materials mined and processed but not removed <br />on the date of termination subject to payment of royalties as provided herein. <br />VIII. INTDEMNIFICATION OF LESSOR <br />Lessee agrees to indemnify Lessor against liability on all claims for damages and injuries <br />to person or property that are claimed to have resulted from the activities or omissions of Lessee <br />or its agents or employees during the terms hereunder. <br />IX. EXCLUSIVE RIGHTS <br />Lessor agrees that during the term hereof, including renewal periods, the Lessee shall <br />have the exclusive right and option to purchase and remove any and all sand, gravel, rock, and/or <br />dirt upon the leased premises, including all sand, gravel, and rock already processed and <br />stockpiled on the leased premises as of the date of execution of this lease agreement. <br />X.
