Lessor agrees to provide Lessee with a sufficient water supply for Lessee's mining and <br />other business operations including, but not limited to, the washing of aggregates. <br />XI. EXHAUSTION OF MATERIALS <br />Upon the exhaustion of materials in the leased premises, this Lease may be terminated <br />by either party giving reasonable notice of not less than sixty (60) days to the other party. <br />XII. DEFAULT OF LESSEE <br />In the event any default occurs in the performance of any term or condition of this Lease <br />by Lessee, Lessor shall give notice in writing to Lessee demanding the correction or removal of <br />such default. Notice shall be deemed given when deposited in the United States mail, addressed <br />to Lessor at his address stated herein. In the event that Lessee fails to correct or remove such <br />default within thirty (30) days from the date notice is given hereunder, Lessor may, at his option, <br />terminate this Lease. If this Lease is terminated by Lessor pursuant to this section, Lessor shall <br />have no further rights or remedies against Lessee except the forfeiture of this Lease, the <br />collection of any accrued royalties or minimum guarantees, the right to accelerate and collect <br />any remaining annual minimum guarantees for the balance of the then current lease term, and <br />reasonable attorneys' fees. Lessee shall have one hundred twenty (120) days after such <br />termination within which to remove any plants, structures, or equipment placed on the Leased <br />premises by Lessee and any materials mined and produced but not removed on the date of <br />termination, subject to payment of royalties as provided herein. <br />XIII. RECLAMATION OF LAND <br />In the reclamation and release of land from this Lease, Lessor and Lessee acknowledge - <br />that they may have conflicting goals. Lessor's goal may be to obtain clear title to and convert <br />reclaimed land to beneficial uses other than gravel mining, such as residential or light industrial <br />purposes. Lessee's goal is to retain that portion of reclaimed land it deems reasonably necessary <br />to facilitate its continuing operations under the terms of this Lease and minimize the necessity <br />of moving its temporary structures and/or equipment to different locations on the leased <br />premises. At the time of execution of this Lease, Lessee is unable to determine the optimum <br />location on the leased premises for these improvements. <br />Recognizing the above potential conflicts, the parties agree as follows: <br />6 <br />
