9. To pay all personal property taxes on the personal property of the Lessee in and <br />about the leased premises. <br />10. Not to cause or suffer or allow any lien, judgment, levy, or attachment to be <br />placed upon the property of the Lessor by reason of any actions of the Lessee of any nature or <br />kind. <br />11. To conduct its gravel mining operation in approximately ten (10) acre parcels with <br />each ten (10) acre parcel being contiguous to a previously mined area commencing with the area <br />already mined. <br />12. To utilize the leased premises as Lessee's primary source of gravel for its <br />operations in the eastern half of Rio Blanco County, Colorado. <br />13. To submit monthly reports showing the quantity of materials removed; to keep <br />strict and accurate records of materials removed; and to permit Lessor to examine mining <br />procedures and check books and records, all as provided in Paragraph II hereof. <br />14. To provide, at Lessee's sole expense, any reclamation bond required by the State <br />of Colorado relative to the mining operations on the leased premises. <br />IV. SURFACE RIGHTS OF LESSEE <br />Lessee may remove and dispose of all brush, trees, undergrowth, and other vegetation <br />from such portions of the leased premises as may e reasonably necessary to explore for materials <br />or to locate roads, pits, quarries, stockpile areas, and/or buildings and equipment. <br />Lessee may erect moveable plant or plants on the leased premises, if it should so desire, <br />to process materials thereon. Lessee may also erect such moveable or temporary building and <br />install such machinery and equipment as may be -useful in connection with its operation <br />hereunder. All such improvements shall be positioned on the leased premises so as to reasonably <br />minimize their impact on the view from Colorado State Highway 13. <br />V. PROTECTION OF PREMISES <br />Lessee agrees to maintain at its cost existing fencing and gates. Gates will be kept locked <br />during the hours of darkness and at all times when the premises is not occupied by Lessee's <br />personnel. <br />4 <br />
