11. To submit monthly reports showing the quantity of materials removed; to <br />keep strict and accurate records of materials removed; and to permit Lessors to examine <br />mining procedures and check books and records, all as provided in Paragraph II hereof. <br />12. To provide, at Lessee's sole expense, any reclamation bond required by the <br />State of Colorado relative to the mining operations on the Leased Property. <br />13. To promptly clean up any releases or spills of hazardous or toxic <br />materials, as such materials may be defined under RCRA, CERCLA or other federal or <br />state laws, to return the Leased Property to its condition prior to such release or spill, and <br />on termination of the Lease, to remove all hazardous and toxic materials from the Leased <br />Property and to indemnify Lessors for any fines, penalties, costs or expenses incurred as a <br />result of any release or spill attributable to Lessee. <br />14. The mining activity on the Leased Property will generally be conducted by <br />mining consecutive 200 foot strips, beginning in the northwestern portion of the Leased <br />Property in a west to east progression. Once each 200 foot area has been mined, the <br />mining activity will move from north to south for each 200 foot portion of the Leased <br />Property to be mined. On the northern boundary of the Leased Property the slope to be <br />mined will be a vertical line at the fence. All materials to the south of the vertical line <br />which are mined will be subject to royalties under this Lease. <br />VI. SURFACE RIGHTS OF LESSEE <br />Lessee may remove and dispose of all brush, trees, undergrowth, and other <br />vegetation from the Leased Property as may be reasonably necessary to explore for <br />materials or to locate roads, pits, quarries, stockpile areas, and/or buildings and <br />equipment. <br />Lessee may erect moveable plant or plants on the Leased Property, if it should so <br />desire, to process materials. Lessee may also erect moveable or temporary buildings and <br />install machinery and equipment as may be useful in connection with its Gravel Mining <br />Operation. <br />VII. PROTECTION OF PREMISES <br />Lessee agrees to maintain at its cost existing fencing and gates. Gates will be kept <br />locked during the hours of darkness and at all times when the Leased Property is not <br />occupied by Lessee's personnel. <br />United/Sheridan Family Gravel Lease 5 <br />
