Rule: 2.05.6 (1) Mitigation of Impacts
Construction/Emissions permits approved in 2006 by CDPHE Air Pollution Control Division are provided
in Section 2.04.8-1 of the permit and adequately address the requirements of this rule.
Rule: 2.05.6(3)(ai, aiii, iv), (bi-vi) Protection of Hydrological Balance
This is a review of how the permit adheres to Rules 2.05.6 regarding the protection of surface water
quality, water rights, control of discharge and probable hydrologic consequences.
This rule was reviewed as per:
The description and mapping of activities protecting the quality and quantity of surface water
within and adjacent to the permit from adverse effects of proposed mining activities during
and after mining.
Control, and treatment of surface water drainage and an examination of hydrologic
consequences of proposed activities.
Rule: 2.05.6(3) is adequately addressed in:
o Permit section 2.04.7, Hydrology Description
o Permit section 2.05.3(3) Mine Facilities and associated tables.
o Table 2.05.6(3)-1 and Attachment 2.05.6, Hydrologic Reclamation Plan
o Permit section 2.05.6 (3) Protection of the Hydrologic Balance
Rule: 4.04 (1b) (2)- (4) Support Facilities
The general requirements of the support facilities description include:
a. Prevent addition of suspended solids to stream flow or runoff outside permit area
b. Minimize and control degradation of water quality and quantity and maintain appropriate
licenses
c. Control and minimize erosion and siltation
d. Control and minimize air pollution and maintain the required permits.
The site is to a large degree reclaimed. The infrastructure is gone and has been bond released. For
ongoing activities and reclamation work Rule 4.04 is adequately addressed in permit section
2.05.3(3).
Rule: 4.05.2 (l)-(8) Water Quality and Effluent Limitations
This Rule addresses drainage from disturbed areas, sediment ponds, and meeting water quality
standards.
The water quality and effluent guidelines required by Rule 4.05.2 have been adequately provided
and include:
a. Surface Water Quality Monitoring Plan in permit section 2.04.7
b. The timey submission of the Annual Hydrology Report (AHR).
New Horizon Mid Term Review Prepared by: R.
