Rule: 2.04.7 (2) Baseline Hydrologic Conditions <br />This is a review of the surface water related sections of the baseline hydrologic conditions and includes <br />surface water flow rates, water quality information, location information of waterbodies and discharge <br />into water bodies. <br />The surface water information required by Rule 2.04.7(2) has been adequately provided and <br />includes: <br />a. Hydrology Description in Section 2.04.7 of the permit. <br />b. Attachment 2.04.7-8 (Peabody Appendix 7-5) <br />C. Maps 2.04.7-1 and 2.04.7-1A, Stream Monitoring Locations. <br />d. Attachments 2.04.7-9 and 2.04.7-11 (Peabody Appendices 7-7 and 7-9 respectively) <br />e. Monitoring data in Section 7, Volume B pgs. 7-123 -7-132 of the New Horizon 1 <br />Reclamation Plan. <br />f. Hydrologic Monitoring Plan (as per TR68) <br />Rule: 2.04.8 Baseline Climatological Information <br />This is a review of the baseline climatological information and includes a climatological summary and <br />data associated with wind speed and direction as well as precipitation and temperature. <br />The climate information required by Rule 2.04.8 has been adequately provided in: <br />Section 2.04.8 of the permit entitled Climatological Information. <br />Rule: 2.05.3 (4)(a) -(d) Operation Plan/ Permit Area <br />This is a review of the requirements for sediment pond construction, design and maintenance and <br />includes a review of the sediment pond as built designs, and maintenance procedures. <br />DRMS finds that as the mine is in reclamation, ponds have been reclaimed or retained with the <br />exception of Ponds 7, 8, 9, 12 and 13 which are currently active ponds. Section 2.05.3(3) and <br />associated attachments of the permit address descriptions, designs and plans for surface water <br />structures adequately meeting the requirements of rule 2.05.3. <br />Rule: 2.05.4(2)(h) Reclamation Plans <br />The general requirements of this section of the reclamation Rule 2.05.4 require a description of steps <br />taken to comply with the Clean Air (42 U.S.C. Sec. 7401 et seq.), and Clean Water (33 U.S.C. Sec. <br />1251 et seq.) acts and other applicable air and water quality laws and regulations and permiting <br />requirements. <br />The proposed activities adequately address the requirements of the Act and the Regulations with <br />respect to safeguarding clean air and water. Section 2.04.8-1 of the permit includes the required <br />documentation as per Rule 2.05.4(2)(h). <br />New Horizon Mid Term Review Prepared by: R.
