Sec. 7401 et seq.), and Clean <br />Water (33 U.S.C. Sec. 1251 et seq.) acts and other applicable air and water quality laws and <br />regulations. <br />The requirements of this section of the reclamation Rule 2.05.3(4) have been adequately met in the <br />permit with the exception of the following: <br />DRMS was unable to locate Exhibit 10 NPDES Permit CO -0036684 and Exhibit 5 NPDES <br />Permit CO -0027154. <br />♦ Please either inform DRMS where the affore mentioned exhibits reside in the permit <br />or provide these exhibits to DRMS for inclusion in the permit. <br />♦ Are all the permits (NPDS and air pollution) still active and necessary? If they are <br />no longer active please provide language in the permit stating that a specific permit <br />number is no longer active and has been terminated. <br />Permit Exhibits 29 and 44 meet the stipulations of the required rule 2.05.4 (2)(h) and include: <br />a. Construction permit # 93RO1204 approved in 1997 by CDPHE Air Pollution Control <br />Division are provided in Exhibit 29. <br />b. Emission permits #920293F, #82RO302F, #890039F, approved in 1992 ; and permits <br />C. #11R05731F, #11R05732F, #11R05733F, #11R05736F, #11R05737F and #11R05738F <br />approved in 1989; and permits #82RO3021, #82RO3022 approved in 1983 by CDPHE Air <br />Pollution Control Division are provided in Exhibit 29. <br />d. The following permit issued by the Water Quality Control Division: permit # CO -00042161 <br />Rule: 2.05.6 (1) Mitigation of Impacts <br />The Permit adequately meets the requirements of Rule 2.05.6(3)(a) regarding emissions permits and <br />meeting air quality requirements Rule 2.05.6(1). <br />Construction and Emissions permits approved at various times by DPHE Air Pollution Control Division <br />are provided in Exhibit 29. <br />Rule: 2.05.6(3)(a)(i). (a)(iii). NO. (bi-vi) Protection of Hvdroloaical Balance <br />This is a review of how the permit adheres to Rules 2.05.6 and 4 regarding the protection of surface <br />water quality, water rights, control of discharge and probable hydrologic consequences. <br />
