(5) Surfacing — Surfacing of roads is discussed on page 2.05-67 and is compliance with the <br />associated Rule. Additional surface discussions are included in each associated light use <br />road section. <br />(6) Maintenance — Maintenance discussion is included in each light use road section. <br />(7) Reclamation — Reclamation discussion is included with each individual road section in <br />Foidel's PAP as needed. Some light use roads will not be reclaimed and is discussed with <br />each section. <br />All topics and discussions required under Rules 4.03.3(1)-(5) have been met in Foidel Creek's <br />PAP. I have no adequacy questions regarding the above mentioned Rule. <br />2.05.3 (8) <br />4.10 <br />(a) — General discussion of coal mine waste and non -coal processing waste begins on page <br />2.05-89.1 and 2.05-96 in Foidel's PAP. Related designs and maps are found in Exhibits <br />8EE, 26A, 26A-1 and 26A-2; Appendix D; and Maps 24 and 25. All requirements for part <br />(a) have been identified in the PAP. <br />(b) — Please refer to Section 4.10. <br />(c) — Please refer to Section 4.11.5. <br />4.10.1(1) — Refuse generated on site is transported within the Foidel creek permit boundary <br />to what is named the Coal Refuse Disposal Area (CRDA) as shown on Map 24. Designs <br />have been certified by a professional engineer, including revisions, as documented in <br />Exhibits 26A, 26A-1, and 26A-2 that satisfy Rule 4.09. Prior to construction, approximately <br />18 inches of topsoil was removed from the footprint of the pile. Permanent diversion ditches <br />have been designed and established and can be seen in Map 24 and Exhibit 26A, Appendix <br />D. Temporary diversion ditches have also been designed to convey 100 -year, 24-hour storm <br />runoff and are to be cut in roughly 50 feet from current CDRA workings. Additional designs <br />for drainage structures associated with the CRDA is presented in Exhibit 8EE. Permanent <br />placement of coal mine waste is outlined on page 2.05-97.5 along with quarterly refuse pile <br />inspection criteria. Discussion regarding slope protection is included in the general <br />discussion of the CRDA as well as exhibits mentioned in this section. <br />4.10.1(2) — This rule is not applicable. <br />4.10.2 — Quarterly inspection reports as well as inspection requirements are detailed <br />beginning on page 2.05-97.5. <br />All topics and discussions required under Rule 4.10 have been met in Foidel Creek's PAP. I <br />have no adequacy questions regarding the above mentioned Rule. <br />4.11.5 <br />This Rule is not applicable. <br />
