Please see additional <br />comments under Item No. 4. <br />6.3.5 Exhibit E — Map <br />12. Illustration No. 3 depicts the permitted area and specifies that the permit boundary <br />encompasses 4.23 acres. The Application Form which was provided to the Division states the <br />permit area would encompass 4.5 acres. Please confirm that the permit boundary will <br />encompass 4.23 acres and provide a revised application form (page 1) which specifies a <br />permit area of 4.23 acres. <br />13. Illustration No. 3 shows the permitted area includes the Mary D claim. According to the <br />Clear Creek County Assessor's records, the Mary D claim (parcel No. 195912400664) is <br />owned by William B. Colsey III. The Applicant has not demonstrated that Teton Drilling, <br />Inc. has a legal right to enter this property as required by Rule 6.3.7. Please demonstrate a <br />legal right to enter the Mary D claim or revise the permit boundary such that it does not <br />encompass the Mary D claim. <br />14. The map scale on Illustration No. 3 states that 1" is approximately equal to 150 ft. The <br />purpose of the scale is to be able to accurately measure distances on the map. An <br />approximate scale is not acceptable. Please revise the map such that the ratio of the distance <br />on the map corresponds exactly to the distance on the ground. <br />15. Exhibit E — Map 1 states the crusher/washer area is 80' x 80'. This contradicts the Mining <br />Plan which states that the crusher/washer area is 30' x 50'. Please revise Exhibit E — Map 1 <br />to be consistent with the Mining Plan. <br />16. Exhibit E — Map 4 identifies the names of immediately adjacent surface owners. Pursuant to <br />Rule 6.3.5(2), the Mining Plan Map must label the names of owner(s) of record of the land <br />within 200 feet of the affected area. This information must be included on a map which <br />contains the permit boundary, so the Division may verify that all of the land owners within <br />200 feet of the affected area have been correctly identified. Please revise this map and ensure <br />that all landowners within 200 feet of the affected area have been identified. <br />17. Exhibit E — Map 4 has identified Clear Creek County as the owner of a parcel located north <br />of the Dixie Mine claim. A review of the Clear Creek County Assessor's records show that <br />this parcel is owned by the U.S. Forest Service. Please revise this label to show that the U.S. <br />Forest Service is the owner or provide documentation to demonstrate that the parcel is owned <br />by Clear Creek County. <br />18. The Reclamation Plan Map states that an additional fire break extension will be created to <br />connect Ute Creek Road to the area where trenching will occur. The Applicant should note <br />the Division will consider this to be affected area and will require the disturbance to be <br />
