The issuance of the <br />permit does not assure the applicant that no injury will occur to another vested water right or preclude another <br />owner of a vested water right from seeking relief in a civil court action. <br />2) The construction of this well shall be in compliance with the Water Well Construction and Pump Installation Rules <br />2 CCR 402-2, unless approval of a variance has been granted by the State Board of Examiners of Water Well <br />Construction and Pump Installation Contractors in accordance with Rule 17. <br />3) Approved pursuant to CRS 37-90-137 (2) and (11) for the construction and operation of a well (gravel pit) in <br />accordance with the temporary substitute water supply plan for the Adams County Nyholt-Mann Pit MLRD-M77525 <br />approved by the State Engineer on March 26, 1993. The well (pond) shall not be operated unless it is included <br />in a substitute water supply plan approved by the State Engineer or a plan for augmentation approved by the <br />Water Court. The water supply plan for this pit is currently valid through April 30, 1994 and if it is not extended <br />or if a court decree is not entered for a plan for augmentation, this well permit is null and void and all use of the <br />water must cease immediately. <br />4) The average annual amount of ground water to be appropriated shall not exceed 124 acre-feet with the total <br />surface area of the proposed ground water pond created after January 1, 1981 limited to 51.7 acres. <br />5) The owner shall mark the well (pond) in a conspicuous place with well permit number(s) and court case number(s) <br />as appropriate. The owner shall take necessary means and precautions to preserve these markings. , <br />6) The use of ground water is limited to evaporation. No other use of water is allowed unless a permit therefor is <br />approved. <br />7) The provision of the Minimum Construction Standards in Rule 10 shall be waived for gravel pit wells except for <br />Rules 10.1 and 10.2.1 regarding aquifer contaminants. The owner of the gravel pit well shall take necessary means <br />and precautions to prevent contaminants from entering the gravel pit well. <br />8) The owner shall submit, after initiation of excavation, the plan and cross-section drawings, on 8 1/2' by 11' paper, <br />showing the extent of excavation, maximum depth of the pit, and the initial static water level. <br />Condition 4 is amended to state "The average annual amount of ground water to be appropriated shall not exceed <br />the Adjusted Net Evaporation determined in accordance with Division 1 Water Court case no. 05CW146, with the <br />total surface area of the proposed ground water pond created after January 1, 1981 limited to 51.5 acres."
