Williamsen: 303-792-2161 <br />Contact phone number for Kurt Carlson (Adams County Regional Park Manager): 303-637-8013 <br />Dear Mr. Williamsen: <br />This letter is in response to your application dated September 24, 2015 submitted on behalf of <br />Adams County Regional Park (Adams County or Applicant) requesting a substitute water supply <br />plan ("SWSP") for the Nyholt-Mann Lake currently permitted under the Division of Reclamation <br />Mining and Safety (DRMS File No. M-82-147). This plan was submitted pursuant to §37-90- <br />137(11), C.R.S. The fee of $1,593 for the SWSP has been received (receipt no. 3671691). <br />Plan Operation <br />The Nyholt-Mann Lake is located at the Adams County Regional Park in the NE1 /4 of Section 34 <br />and 5E1/4 of Section 27 all in T1S, R67W, 6th P.M. A plan for augmentation was decreed for <br />replacement of evaporation in Division 1 Water Court Case no. 05CW146. The site consists of 3 <br />lined storage reservoirs (Mann Lakes, WDID 0203911) and one unlined reservoir (Nyholt-Mann Lake <br />Pit, WDID 0210294), as shown on attached Figure 1. Mann Lakes has passed the seepage loss tests <br />and the inlet and outlet works will be installed in the near future. Until such time as Mann Lakes <br />are operational, the Applicant cannot operate under the decreed augmentation plan. Therefore, <br />the Applicant is seeking this SWSP to replace depletions from Nyholt-Mann Lake until such time as <br />they can begin operation under the decreed augmentation plan. <br />Nyholt-Mann Lake was created by sand and gravel mining operations and all mining operations at <br />the site have ceased. This SWSP seeks to replace the evaporation depletions from Nyholt-Mann <br />Lake using water leased from the City of Aurora (Aurora). <br />Water flows into the Nyholt-Mann Lake from Brantner Gulch. The Applicant must release all <br />out -of -priority storage in the Nyholt-Mann Lake within 72 hours or augment such out -of - <br />priority storage under a separate SWSP or court approved augmentation plan. In order to <br />assure that water is not being stored out -of -priority the Applicant must install measuring and <br />recording devices as required by the division engineer and water commissioner to measure <br />the amount of water flowing into and out of Nyholt-Mann Lake.
