Please provide a description of the various controls that will be in place to ensure that water <br />diverted from the Platte City Ditch will not be able overflow the surge pond, water holding <br />pond or settling pond. <br />14. The Applicant has stated inert fill may be imported into the site. Please commit to providing <br />updates on this activity in the Annual Report. Updates reported to the Division should <br />include the approximate volume of material which was imported and the areas where inert <br />fill was backfilled shall be depicted on the Annual Map. Please respond. <br />6.4.5 Exhibit E — Reclamation Plan <br />15. The Reclamation Plan states on Page E-1 that the water holding pond and surge pond would <br />be filled in during final reclamation. However, Page E-2 of the Reclamation Plan states that <br />the area of the sluice and settling pond, water holding pond and surge pond would not be <br />reclaimed. Please clarify this discrepancy and revise the Reclamation Plan as necessary. <br />16. The Reclamation Plan states on Page E-3 that the Applicant understands that the commercial <br />and residential areas cannot be released until those post -mine uses have been accepted by <br />Park County. Please clarify what land uses the property is currently zoned for and submit <br />documentation to demonstrate these land uses have been approved. If the property is not <br />currently zoned for any of the proposed post -mining land uses, then the Application and all <br />applicable Exhibits must be revised to remove any post -mining designation for which the <br />property is not currently zoned for. <br />17. The majority of the mine site is to be reclaimed to wildlife habitat (26.07 acres). The area to <br />be reclaimed to wildlife habitat currently consists of a forested area. Please provide an <br />explanation of why forbs, shrubs and trees were not included in the seed mix. The Division <br />believes the inclusion of the forbs, shrubs or trees would be appropriate for the areas <br />designated as wildlife habitat. <br />6.4.7 Exhibit G — Water Information <br />18. The Operator has committed to taking groundwater measurement once per year at the <br />groundwater well adjacent to the residence within the permit area and the groundwater well <br />owned by Donald and Jesse Peterson. The Division believes that groundwater monitoring <br />data would be more useful if groundwater measurements were collected on at least a <br />quarterly basis. The Division considers the groundwater monitoring plan to be a formal <br />commitment on the part of the Operator and it will become an enforceable condition of the <br />Reclamation Permit.
