Table D-1 of the Mining Plan breaks down the various types of disturbance which will occur <br />on the north and south sides of the Middle Fork of the South Platte River (River). The types <br />of disturbance for the area north of the River lists 0.18 acres associated with the old highwall <br />and Settling Pond 3. Exhibit C-2: Mine Plan Map shows the old highwall and Settling Pond 3 <br />on the south side of the River in Mine Area 4. Please clarify the location of the old highwall <br />and Settling Pond 3 and revise Table D-1 as necessary. <br />10. Table D-1 of the Mining Plan specifies that the water holding pond and surge pond account <br />for 0.3 acres of disturbance. However, Page E-2 of the Reclamation Plan states that the water <br />holding pond and surge pond will be 0.36 acres. Please clarify this discrepancy and make the <br />necessary revisions to the appropriate Exhibit. <br />11. The Mining Plan states on Page D-21 and D-22 that the total area disturbed at any given time <br />will be 0.9 acres of affected land for the active mining area and 1.6 acres of ancillary <br />disturbance, which would result in a total disturbance of 2.5 acres. However, the Mining Plan <br />states the maximum disturbance at any one time is 2.02 acres. The Division has determined <br />the maximum disturbance at any one time could be up to 2.86 acres; see additional comments <br />under Item No. 8. Please provide a description of the ancillary disturbance and provide a <br />justification for a maximum affected area of 2.02 acres. <br />12. The Mining Plan states on Page D-6 that all gold bearing gravel south of the River will be <br />processed at the South Location, located on relatively flat ground west of the <br />office/residence. Please clarify if Settling Pond 3 will be utilized in the processing of gold <br />bearing gravel. If so, please demonstrate that there will be enough room to contain the wash <br />plant equipment, product stockpiles and wash fines such that all associated disturbance is <br />located outside of the 100 year floodplain. <br />
