In the Division's Adequacy Letter dated May 21, 2015, the Division requested a copy of <br />Exhibit A, which included the legal description for Parcel # 47300. The Applicant's response <br />did not include a copy of Exhibit A. Please submit Exhibit A or other documentation which <br />demonstrates the submitted property deed correlates to Parcel #47300. <br />20. The legal right of entry for Parcel # 11655 and #11850 does not conform to the requirements <br />of Rule 6.4.14. The signed statement from the landowner must include acknowledgment by a <br />Notary Public. Please provide a notarized statement from the landowner demonstrating a <br />legal right of entry by JRS Mining LLC onto Parcel #11655 and #11850. <br />6.4.15 Exhibit O — Owner(s) of Record of Affected Land (Surface Area) and Owners of <br />Substance to be Mined <br />21. Table O-1 of Exhibit O lists Criselda Miller and Mark Edward Miller as a surrounding <br />landowner within 200 feet of the permit boundary. However, the list of certified mail receipts <br />does not include a mailing to Criselda and Mark Edward Miller. Please provide copy of the <br />certified mail receipt if one is available. If the Applicant did not provide a notice to this <br />landowner(s), then a copy must be provided to them and they must be afforded an <br />opportunity to provide comments on the application that is currently under review. <br />22. The certified mailing to surrounding landowners within 200 feet of the permit boundary <br />included the following landowners who were not listed on Table 0-1: <br />a. High Speed Aggregate Inc. <br />b. Gene V. Coker and Lynda S. Coker <br />c. Thomas S. and Kathleen Greising <br />d. Fanie Mae <br />e. Ryan Grossman <br />Please clarify that the above listed landowners own property within 200 feet of the permit <br />boundary and revise Table O-1 as necessary. <br />23. Map B-2 of Exhibit O shows that the property owned by Rock N Pine LLC (Parcel # 29844) <br />is located within 200 feet of the permit boundary. However, the landowner is not listed on <br />Table 0-1. Please clarify this discrepancy and revise Table 0-1 as necessary. <br />24. The list of certified mail receipts demonstrating that damage waivers were sent to structure <br />owners included Rock N Pine LLC. Exhibit S does not identify any structures within 200 feet <br />of the permit boundary owned by Rock N Pine LLC. Please clarify if the certified mailing to <br />Rock N Pine LLC included a damage waiver agreement for a permanent man-made structure <br />or if it included public notice of the application. <br />
