AGGREGATE
Mr. Tyler O'Donnell, Division of Reclamation Mining and Safety INDUSTRIES
Page Two
Land Reclamation Board hearing held yesterday
By e-mail dated August 25, 2015, Emily Hunt of Thornton communicated that Adams
County has been included in the Federal Emergency Management Agency disaster
declaration for the State of Colorado. A copy of Ms. Hunt's e-mail and FEMA
Amendment No. 1 to Notice of a Major Disaster Declaration are enclosed for reference.
Ms. Hunt's e-mail further states that coordination with FEMA and the State Office of
Emergency Management will be required to design and repair damages and that a
separate coordinating and approval process will be required with the State and FEMA
relative to flood control mitigation improvements. Thornton is actively preparing a scope
of services and pursuing appropriate agency guidelines and approvals to standards that
will ultimately address the corrective action the Division seeks.
Thornton's initial meeting with FEMA is scheduled for August 27. As shown in the
Chronology of West Cooley Reservoir Flood Damage Related Events prepared by
Thornton, which was also included under AI's Exhibit 5 for yesterday's MLRB hearing,
the FEMA approval process can take considerable time. It is unknown when a flood
control mitigation plan that meets agency requirements and approvals will be available;
however, Al proposes to communicate with Thornton regarding its progress and will
either submit the required plan or provide a status update to the Division and request an
additional extension of time by September 30, 2015.
We appreciate your consideration in this matter.
Very truly yours,
Connie N. Davis
Land Advisor
Enclosures
cc: Tony Waldron (tony-waldron2state.co.us)
Wally Erickson (wally.erickson@state.co.us)
Timothy J. Flanagan, Esq. (t_flanagan@fsf-law,com)
