August 27, 2015 <br />RECEIVED <br />AUG 2Gru15 <br />DIVISION OF RECLAMATION <br />MINING AND SAFETY <br />A�Mr. Tyler O'Donnell <br />Division of Reclamation Mining and Safety AGGREGATE <br />1313 Sherman Street, Room 215 <br />INDUSTRIES <br />Denver, CO 80203 <br />Re: Permit No. M-1999-034— Cooley Reservoir and Fulton Wildlife Area <br />p, Corrective Action Extension Request <br />Dear Tyler: <br />Aggregate Industries (AI) is requesting an extension of time to address a corrective action <br />item set forth in the Division's report of its July 2 and July 9, 2015 inspections of Cooley <br />Reservoir. The corrective action requiring submittal of a flood control mitigation plan to <br />include armored inlet and outlet spillway structures for the entire reservoir complex is <br />currently due on or before August 31, 2015. Al is seeking an initial extension of that date <br />for a minimum of thirty (30) days in order to accommodate City of Thornton's rights and <br />interests in Cooley Reservoir, reservoir facilities and land and as well as Thornton's <br />ability to obtain appropriate agency approvals and funding for flood restoration and <br />mitigation improvements. <br />While Aggregate Industries has not been released from Permit No. M-1999-034, <br />Thornton is the owner of Cooley Reservoir, its associated facilities and land. Thornton <br />purchased the land and reservoir from Aggregate Industries following Division of Water <br />Resources approval of the slurry wall surrounding the reservoir and its interior dikes. <br />Thornton is working with County, State and Federal partners to apply for funds to repair <br />damages sustained at Cooley Reservoir due to flooding of the South Platte River during <br />June and July, 2015 and to complete long-term improvements to mitigate potential <br />impacts from future flooding. On July 28, 2015, Thornton's City Manager declared a <br />local disaster emergency and City Council approved a continuation of the local <br />declaration until an Adams County declaration was accepted by the State. The <br />declaration provided for initial emergency repairs, which included repairs to river <br />breaches as required by the Division, and an opportunity to recoup an estimated $930,00 <br />for those repairs along with eligibility for future long-term mitigation funding.
