This item was addressed during PR07. <br />These four items did not require a response from Trapper. A fourth adequacy review letter was <br />sent to Trapper on January 25, 2013. This letter identified six additional items that needed to be <br />addressed in regards to the proposed revisions to their Ownership and Control information <br />contained in section 1.2.1 of the permit. Trapper responded to these concerns on February 4, <br />2013. The Division issued a proposed decision to approve RN6 on July 9, 2013. The Decision <br />became final on August 28, 2013. <br /> <br />PR7 <br /> <br />The Division received the PR7 application on May 21, 2013. As discussed above, the <br />application proposed to increase the permit area by 774.39 acres, from 10,382.30 acres to <br />11,156.69 acres. No actual disturbance was proposed within the proposed permit expansion <br />area. The application was deemed complete on May 31, 2013. Trapper published a public <br />notice in the Craig Daily Press for a period of four consecutive insertions beginning on June 14, <br />2013. The Division sent a preliminary adequacy review of PR7 on July 29, 2013. The review <br />consisted of thirty-eight adequacy review items. Several of the items pertained to baseline <br />environmental resource information required by Rule 2.04 for the PR7 expansion area. The rule <br />required a number of baseline items for the entire permit expansion area, regardless of whether <br />mining was proposed within the permit expansion area or not. The rule additionally required a <br />number of baseline items only for areas to be mined within the expansion area. The application <br />for PR7, however, did not request any disturbance within the permit expansion area. Given this, <br />a number of items required by Rule 2.04 for areas to be mined within the permit expansion area <br />were not submitted with PR7. The Division and Trapper agreed that a stipulation would be <br />added to the permit requiring Trapper to submit and obtain approval of an application for a <br />permit revision providing specific environmental resource information required by Rule 2.04 for <br />areas to be mined prior to conducting any surface coal mining operations in the PR7 expansion <br />area (Stipulation No. 22). Adequacy items that required resolving included the need for detailed <br />designs of the reconstructed post-mining drainage channels, clarification of the reclamation cost <br />estimate submitted with the PR7 application, and other textual updates and changes. The <br />Division met with Trapper on November 12, 2013 to discuss the adequacy review items and the <br />reclamation cost estimate. <br />nd <br />adequacy review on January 28, 2014. The Division sent a 2 adequacy review letter on <br />February 27, 2014. The letter had several follow-up adequacy review items based on Trappers <br />rd <br />response. The Division sent a 3 adequacy review letter on February 27, 2014. This letter <br />review letter, the November 12, 2013 meeting and the approval of the SL14 and SL15 Phase I <br />bond release applications in January and February of 2014 respectively. The Division received a <br />ndrd <br />response from Trapper for the 2 and 3 adequacy review letter on July 8, 2014. The letter <br />-up items and included drainage reconstruction designs. The <br />Division sent a fourth adequacy review letter on July 29, 2014 that cited several follow-up items <br />ndrd <br /> and 3 adequacy review letters. Also cited in the fourth <br />adequacy review letter were three additional adequacy review items regarding a discrepancy in <br />the accounting of the disturbance acreage at the site. Trapper and the Division met on August <br />th <br />21, 2014 to discuss the concerns raised in the 4 adequacy review letter specifically regarding <br />drainage reconstruction.
