did not contribute sediment in excess of that generated by undisturbed lands. The CDPS <br />discharge permit was terminated in 2009. <br />E. Acid-forming and Toxic -forming Spoil (4.05.8) <br />Spoil from the Carbon Junction Mine was determined to not be acid-forming and toxic - <br />forming. <br />F. Surface and Ground Water Monitoring (4.05.13) <br />1. Prior to 2006, the applicant monitored the quality and level of ground water in wells <br />17B, 94-1, and 95-1. The application for Technical Revision 13 demonstrated that: <br />a) the operation has minimized disturbance to the hydrologic balance in the permit <br />and adjacent areas, b) material damage to the hydrologic balance outside the permit <br />area has been prevented, and c) water rights of other users have been protected. <br />Based on this demonstration, the ground water monitoring plan was deleted <br />(4.05.13(1)). The baseline data results are discussed and tabulated in appendix 4-3 of <br />the permit application <br />2. The applicant previously conducted monitoring of surface water in a manner <br />approved by the Division. The monitoring plan was submitted under 2.05.6(3)(b)(iv) <br />and includes the following: (4.05.13(2)). <br />a. Baseline data and results are included in Appendix 4-3 of the permit. <br />b. Three springs, (1, 3, and 4) were monitored prior to 2006. Monitoring of these <br />springs was deleted in TR -13 based on the demonstration described in the <br />preceding discussion of ground water. <br />c. NPDES sites (sediment pond outlets) no longer have monthly maintenance, <br />service, flow measurements, field parameters, and quarterly full suite water <br />quality samples. The ponds were removed in 2008, and the CDPS was <br />terminated in 2009. <br />G. Transfer of Wells (4.05.14) <br />The applicant has not requested the transfer of exploration or monitoring wells <br />(4.05.14(2)). <br />H. Probable Hydrologic Consequences <br />Probable Hydrologic Consequences of the mine's operations are detailed in Section <br />2.05.6(3) of the RN -04 Abridged Permit Document. <br />IV. Topsoil — Rule 4.06 <br />Topsoil Stockpiles 94 and 97 were approved for retention as permanent features under TR -16 in <br />June 2010. The Division determined that a sufficient thickness of topsoil had been distributed <br />upon the reclaimed areas and that leaving the stockpiles in place would not hinder achievement <br />of approximate original contour. <br />V.
