C. Light -Use Roads <br />The Division previously approved the retention of the light use road constructed to access <br />Well B-10, east of the former South Pit. The road's use was deemed compatible with the <br />then -approved post -mining land uses, and a request for its retention was submitted by the <br />landowner (4.03.3). A light use road unrelated to mining activities was constructed by <br />the landowner in the vicinity of former Sediment Pond 2, as approved under MR -17. The <br />Division finds that both of these light -use roads would continue to support the new post - <br />mining land use of dryland pasture, and re -approves their retention. <br />IL Support Facilities — Rule 4.04 <br />Construction of support facilities was not predicted to affect water wells located within the <br />permit area. Therefore, the Division approved those activities (4.04(6)). Those support facilities <br />have since been reclaimed. <br />III. Hydrologic Balance — Rule 4.05 <br />A. Water Quality Standards and Effluent Limitations (4.05.2) <br />The Division did not grant exemptions from sediment ponds and/or treatment facilities. <br />Two sediment ponds were constructed and maintained throughout the life of the <br />operations. The ponds were reclaimed in 2008 upon the applicant's making a <br />demonstration that reclaimed areas did not contribute sediment in excess of that generated <br />by undisturbed lands. The CDPS discharge permit was terminated in 2009. <br />B. Diversions and Conveyance of Overland Flow (4.05.3) <br />The Division approved temporary diversion of the Carbon Junction channel. Flow was <br />intermingled with runoff from the disturbed area, and directed to Sediment Pond No. 1. <br />Flow from Carbon Junction Canyon was redirected to the permanent diversion channel <br />when the ponds were removed in 2008. The Division approved the use of a riprap lining <br />for the permanent diversion. The lining will provide stability in order to protect fills and <br />property and to avoid danger to public health and safety. The diversion is located in <br />Carbon Junction Canyon, and diverts flow around the Previously Reclaimed Spoils Area <br />and the former Sediment Pond No. 2. The diversion discharges into a tributary to Carbon <br />Junction Canyon. Design details are found in Section 2.05.4 of the permit, while As -Built <br />documentation is found in Appendix 5-12 (4.05.3(3)). <br />C. Stream Channel Diversions <br />No diversions of ephemeral streams draining at least one square mile, or intermittent, or <br />perennial streams were proposed or approved. <br />D. Sedimentation Ponds (4.05.6) <br />Two sedimentation ponds were approved by the Division. The ponds were not located in <br />a perennial stream (4.05.6(l)(b)), and no alternative design criteria or specifications were <br />approved for use in sediment pond design and/or construction (4.05.6(l1)).
