Mr. Wayland
Page 3
July 24, 2015
6.4.7 Exhibit G — Water Information
11. The Applicant is proposing to dewater the BNER in order to install the clay liner. Pursuant to
Rule 3.1.6, disturbances to the prevailing hydrologic balance of the affected land and of the
surrounding area and to the quantity and quality of water in surface and groundwater systems
both during and after the mining operation and during reclamation shall be minimized. To
satisfy the requirements of Rule 3.1.6, the Operator shall provide the following information:
a. The Applicant shall define the cone of depression for any areas to be dewatered. The
cone of depression should define, at a minimum, the horizontal and vertical extent of
expected impacts. As part of this assessment, the Applicant will identify the owner of
any permitted and/or adjudicated water right that may be adversely affected and will
provide a mitigation plan for such permitted and/or adjudicated water right. Also, the
Applicant will provide the Division with a detailed groundwater investigation to
verify whether the proposed rate of pumping, expected drawdown rate, and expected
cone of depression during maximum pit disturbance will or will not adversely affect
the owner of any permitted and/or adjudicated water right. If the groundwater
investigation indicates that any owner of a permitted and/or adjudicated water right
may be adversely affected, the Applicant will provide a mitigation plan for such
permitted and/or adjudicated water right. The mitigation plan shall include a scenario
for the installation of a French drain to direct groundwater around the clay lined pond
in order to restore groundwater elevations to the historic elevation in an area of
groundwater monitoring.
12. Please provide the Division with a groundwater monitoring plan to verify the presence or
absence of impacts to the groundwater system. At a minimum, the monitoring plan shall
include the following:
a. The location of monitoring stations.
b. Frequency of water table elevations to be collected.
c. Commitments for reporting measurements to the Division.
13. Please identify all registered alluvial wells within 600 feet of the BNER and locate the wells
on the Reclamation Plan Map or on a separate map.
14. Please specify the depth to ground water in the location of the BNER.
15. Please clarify if the water shares which were dedicated to the SEO account for water in both
the BNER and the Pfeiff pond.
