The letters are attached for your review. <br />Please address the comments noted in the letters and make any changes to the application as <br />necessary. <br />6.4.5 Exhibit E — Reclamation Plan <br />4. The Applicant is proposing to add Residential and Industrial uses to the post -mining land <br />use. Please provide documentation from Larimer County which demonstrates that the <br />property is zoned for those uses. <br />5. The Applicant has stated the pond on the Pfeiff property has been lined and is pending a <br />leakage test. Please specify the anticipated timing of the leakage test. <br />6. The Pfeiff pond is partially located within the permit boundary. Please explain why a portion <br />of the pond is not within the permit boundary. Was there an existing pond at this location <br />which was expanded during mining? <br />7. The Reclamation Plan calls for additional backfilling a portion of the Brownwood North East <br />Reservoir (BNER). Please specify the source of this material. If the material will be imported <br />from offsite, then you must provide a Notice of backfill activity as required by Rule 3.1.5(9). <br />The Notice shall include the following information: <br />a. A narrative that describes the approximate location of the proposed activity. <br />b. The approximate volume of inert material to be backfilled. <br />c. A signed affidavit certifying that the material is clan and inert. <br />d. The approximate dates of the proposed activity will commence and end, however, <br />such dates shall not be an enforceable condition. <br />e. An explanation of how the backfilled site will result in a post -mining configuration <br />that is compatible with the approved post -mining land use. <br />f. A general engineering plan stating how the material will be placed and stabilized in a <br />manner to avoid unacceptable settling and voids. <br />8. Please verify that the depth of water within the BNER will be approximately 8 feet. <br />6.4.6 Exhibit F — Reclamation Plan Map <br />9. Please revise the Reclamation Plan Map to include a note that the Pfeiff pond has been clay <br />lined. <br />10. As required by Rule 6.2.1(2)(e), please revise the Reclamation Plan Map to include a north <br />arrow. <br />
