June 9, 2015 C-1981-013/Golden Eagle Mine JHB <br />north controls the runoff coming off the gas well road and running on to the Golden Eagle permit, this drainage is <br />expected to continue to be a problem. Several of the hay bales need to be replaced. NECC has attempted to <br />contact the landowner without success. <br />The north end of the upland diversion ditch has sloughed in with material from upslope (west) of the ditch. Hand <br />work on this ditch may help control runoff from west of the reclaimed area from running down the hill and adding <br />to the drainage running on from the northern property. <br />ROADS — Rule 4.03 <br />Reclamation 4.03.1(7)/4.03.2(7): <br />Reclaimed roadways vegetation has filled in well and not eroding. The Golden Eagle site continues to <br />experience run on from the property to the north from a gas well road. <br />RECLAMATION SUCCESS - Rule 4.15, Rule 3: <br />NECC has contracted with Arcadis to conduct vegetation sampling on the reclaimed vent shaft and the <br />grassland reference area. The operator, consultant and Division held a conference phone call on June 4, 2015 to <br />discuss the planned sampling methodolgy. The remaining reclaimed vent shaft site of the Golden Eagle Mine <br />permit accounts for approximately 1.20 acres. Sampling this small area in a completely random method has a high <br />probability of double sampling due to cover transects and production quadrats overlapping one another. Arcadis <br />proposed and the Division concurred that a systematic -random sampling approach would be followed. <br />Arcadis will lay out a randomly located base transect south to north. 25 M long transects will start at 1M, then <br />every 4M, along this base line extending to the east. <br />Cover sampling will be conducted to sample adequacy with a minimum of 15 transects. Cover data will be <br />collected using an occular point frame, with 2 points collected every meter along the transect. <br />Two 1/4 M Production quadrats will be harvested along each cover transect. All forbs and graminoid species will <br />be harvested. Woody plants, noxious species, cacti, and mosses will not be harvested. Arcadis stated that they <br />would collect production to sample adequacy or a minimum of 30 samples. <br />There is no evidence that the reclaimed site has been grazed yet this year. <br />The Division concurs with the sampling protocol. <br />The grassland reference area was observed on 6/9, and again on 6/10 when Arcadis was sampling. The grassland <br />reference area is located south west of the previously released Golden Eagle haul road. The vegetative cover at the <br />grassland was good with a good stand of blue grama grass intermixed with other native grassland species. This <br />community is dissimilar from the Pinyon Juniper community observed surrounding the reclaimed area but is the <br />approved reference area in the Golden Eagle permit. <br />The consultant will use the same sampling method to sample the reference area as they use for the reclaimed area. <br />Number of Partial Inspection this Fiscal Year: 8 <br />Number of Complete Inspections this Fiscal Year: 4 <br />Page 3 of 7 <br />
