Mr. Striggow <br />Page 4 <br />May 13, 2015 <br />The Mining Plan does not specify the distance between the edge of the excavation and the <br />edge of the road. The Operator shall describe how the road and the Poudre Valley Canal will <br />be protected from any adverse effects of the mining operation. The Mining Plan shall specify <br />the following: <br />a) The minimum distance between the eastern edge of the quarry and the western edge <br />of the access road. (All offsets must be depicted on the Mining Plan Map) <br />b) The grade of the quarry wall which will run parallel to the access road. <br />c) The total depth of the quarry at the closest point to the access road. <br />d) A description of the material beneath the road, i.e., off-site fill or native material. <br />Please provide any available borehole data for the access road. <br />19. The Operator is proposing to excavate areas approximately 75' x 75'. The Operator has <br />chosen to limit the financial liability by setting a maximum allowed disturbed area, which is <br />currently set at 41.78 acres. According to the most recently submitted Annual Report, the <br />Operator has affected 38 acres. Therefore, the Operator may disturb an additional 3.78 acres, <br />which is roughly equivalent to the size of the amended area. Please clarify if the Operator <br />intends on increasing the amount of land to be disturbed or if the maximum allowed <br />disturbed area will remain at 41.78 acres. The Operator should note that the financial <br />warranty amount of $234,500.00 will be evaluated for adequacy even if the maximum <br />allowed disturbed area is not increased. <br />20. Please specify if any additional haul roads will need to be constructed to access the amended <br />area. If so, provide the dimensions of the haul roads and depict the roads on the Mining Plan <br />Map. <br />6.4.5 Exhibit E — Reclamation Plan <br />21. The Reclamation Plan calls for placing riprap in areas that are likely to erode. Please provide <br />the Division with the following information: <br />a) Identify areas where riprap will be placed on the Mining Plan Map. <br />b) Specify the size of the riprap and the total volume of riprap to be placed. <br />c) Specify the timing of riprap placement. <br />d) Specify if riprap will be removed during final reclamation of the site. <br />22. The Reclamation Plan states that areas which are approximately 15' deep will be reclaimed. <br />However, the Mining Plan states that approximately 10' of overburden will be removed to <br />reach a layer of sandstone that is approximately 15' thick. If the entire layer of sandstone is <br />excavated, then the total depth of the excavation would be closer to 25'. Please clarify this <br />discrepancy and revise either the Reclamation or Mining Plan to accurately reflect the total <br />depth of the excavation. <br />
