f. Lessee shalt be responsible for stripping and reclamation activities in the areas <br />Lessee mines. Lessee shall reclaim all such mined areas at least substantially in <br />accordance with the reclamation plan under the Permits and to the satisfaction of <br />the Division of Minerals and Geology <br />17. Liens; Claims. If, because of any legally proven act or omission of Lessee, its agents, <br />employees, licensees, invitees, any claim is made against Lessor's reclamation bond or if <br />any mechanic's lien or other lien, charge or order for the payment of money shall be filed <br />against Lessor or any portion of the Leased Premises, Lessee shall, at its own cost and <br />expense, cause the same to be discharged oFrecord or bonded within thirty (90) days after <br />the filing thereof. <br />18. Termination At Expiration. <br />At least 90 days prior to the end of the Lease Term, Lessee shall give notice to <br />Lessor of Lessee's intent to quit the Leased Premises at the end of such Lease <br />Term, and Lessee shall have no further Minimum Monthly Royalty obligations <br />beyond the end of such Lease Term if its prior Minimum Monthly Royalty <br />obligations during such Lease Term have been Fully met pursuant to the terms of <br />this Lease. Within 90 days after the end of the Lease Term, Lessee shall remove <br />from the Leased Premises all equipment, vehicles, stockpiled materials and other <br />improvements or personal property and shall complete reclamation of the Leased <br />Premises to the condition required by the Permits and this Lease. Any lack of <br />notice to Lessor shall be deemed as Lessee's intent to extend the Lease Term per <br />Paragraph 3. above. <br />b. in the event Lessee fails to make any payment when due hereunder, or in any <br />other way breaches the terms of this Lease, Lessor may give notice of <br />default. Such notice shall contain a thirty (30) day right to cure prior to <br />termination. If such failure is not corrected within thirty (30) days after the notice <br />specifyin the -lure - Ic ssoa..niay- .terminate,_this-- <br />Lease. <br />19. Default by Lessor. In the event that Lessor breaches the terms of the Lease, Lessee may <br />give notice of default. Such notice shall contain a thirty (30) day right to cure prior to <br />termination. If such failure is not corrected within thirty (30) days after the notice <br />specifying the failure or breach that has occurred, Lessee may terminate this Lease. <br />20. Insurance. Lessee agrees to keep in full force and effect, and pay the premiums thereon, a <br />policy or policies of public liability and property damage insurance covering all of <br />Lessee's operations on the Leased Premises with liability limits of at least $2,000,000.00 <br />per person and per occurrence. Lessee also agrees to procure, maintain in effect, and pay <br />the premium on a policy or policies of Workmen's Compensation Insurance insuring <br />Lessee's employees in the amounts required by law.
