14. Records to be kept. Lessee shall keep accurate records of quantities, nature and weights <br />of materials on which Production Royalties are due, which records shall be available for <br />inspection by Lessor at all reasonable times during business hours. Production records <br />shall be kept for a period of three years after their creation. <br />15. Audit Cost. Lessor may cause an audit of Lessee's books and records once annually in <br />the first week of the third quarter of the year (July), for purposes of verifying the amount <br />of Production Royalty due to Lessor. All reasonably necessary records, including records <br />of crusher hours logged in Tenant's operation on the Leased Premises, shall be made <br />available to Lessor or its agents for such purposes. The fees of the auditors shall be paid <br />by Lessor, unless the audit discloses an understatement of the Production Royalty <br />properly due to Lessor in excess of two percent of the amount of the Production Royalty <br />reported, in which event Lessee shall pay the fees of the auditors. <br />16. Lessee's Operations on Premises <br />a. Lessee shall use the Leased Premises only for mining, extraction and processing <br />of Sand and Gravel, production of concrete and asphalt, and storage and <br />maintenance of equipment and raw materials therefor, and shall not use the <br />Leased Premises, or permit them to be used for any other trade, business, <br />manufacture or occupation. All material mined and crushed by Lessee will <br />become the property of Lessee. <br />b. If required, Lessee shall prepare and file a Storm Water Management Plan, and <br />Lessee shall be responsible for implementing procedures and monitoring <br />compliance with said Plan. Lessor shall provide a clean, clearly marked map of <br />the permitted area so that Lessee may set up and commence operations in the <br />permitted area. <br />c. Neither Lessor nor the Lessee shall use the Leased Premises, or permit them to be <br />used for any nuisance, or anything against public policy, or for any put-pose or use <br />..`�_ -- '- ----- -- in- vitrl-aeiocr -o-f t}�e�- laws -or -- rules- artd-- ragulations��ur�ga�� rnme��.dy,^o� _ <br />authority applicable to the Leased Premises. <br />All provisions and revisions, amendments, expansions, or modifications to <br />Lessee's Permits shall be shared with Lessor upon execution of this document and <br />at the time any of such are received by the Lessee. Those provisions and <br />revisions, amendments, expansions, or modifications to Lessee's Permits are <br />incorporated herein and become part of this agreetnent. <br />e. Lessee shall comply with all applicable federal, state and local laws, rules and <br />regulations of governmental budies and agencies regulating the Leased Premises <br />and with all conditions and requirement of the Permits insofar as such conditions <br />and requirements pertain to operations hereunder by Lessee on Lessor's Property. <br />
