certificates evidencing such insurance to Lessor, and shall include Lessor as an additional <br />named insured under the commercial general liability coverage. <br />21. Lessor's Covenants and Warranties. <br />a. Lessor covenants and warrants and agrees to defend Lessee in the quiet enjoyment <br />and possession of the Leased Premises during the Term of this Lease, subject to <br />the terms and conditions hereof. <br />b. Lessor further represents and warrants to Lessee that Lessee shall have reasonable <br />and uninterrupted access to the Leased Premises, as required for its operations <br />during such regular operation hours as are authorized by the Permits during the <br />Term hereof, subject to the terms and conditions of this Lease_ <br />c. Lessor covenants that it will maintain in effect all, if any, Permits for which it is <br />responsible for so long as Lessee is conducting extraction and processing <br />operations for Sand and Gravel on Lessor's Property per the terms of this Lease. <br />Any material change, expiration or revocation of the Permits, shall be <br />immediately communicated to Lessee upon Lessor's knowledge of such. In the <br />event of material change, expiration or revocation of the Permits, and upon <br />Lessor's communication of such to Lessee, Lessee may choose to terminate this <br />Lease under the terms contained herein. <br />22. Lessee's Covenants and Warranties. <br />a. Lessee shall pay when due the Production Royalty and all other amounts due <br />Lessor or any third party hereunder. Amounts due Lessor that are not paid when <br />due under the terms of this Lease shall bear interest at twelve percent (12 %) per <br />annum. <br />b. Lessee shall conduct its operations on the Property in a prudent and workmanlike <br />w... —..._ manner _in-aerordame- with.goodLaai vmMd. -minin and business practices and _ <br />in compliance with all applicable federal, state and local laws, rules and <br />regulations, including without limitation those relating to safety, health and the <br />environment. <br />c. Tenant shall keep the Leased Premises free and clear of liens, charges, claims or <br />demands arising from Lessee's operations hereunder and shall promptly pay for <br />all labor performed on the Leased Premises and for all supplies, materials, and <br />equipment used or placed on the Leased Premises. Lessee may contest in good <br />faith any lien; provided that, Lessee shall not allow title to the Leased Premises or <br />any portion of it to be lost. <br />
