According to Section 2.4.2 <br />of the permit, there are no areas within or adjacent to the mine plan area that have been or are pending <br />designation as "essential habitat" for any of the threatened or endangered species that could potentially <br />occur within the permit area. Given this specific control measures, management techniques and <br />monitoring methods to protect or enhance threatened or endangered species is not discussed. <br />(b) Powerline structures are designed to protect birds and raptors. Reclamation activities and the creation <br />of stock ponds enhance the wildlife value at the site. Appendix W of the permit is updated every year to <br />depict the new dozer basins, shrub clumps and reclamation activities at the site which enhance wildlife <br />value. <br />(c)This rule discusses a specific requirement of the Division to provide the wildlife resource information <br />to the U.S. Fish and Wildlife service within 10 days of request. <br />There is one item that will need to be addressed: <br />• A prairie falcon nest site and buffer zone is depicted on Map M25A of the permit. Map M25A is <br />out of date and needs to be updated. Page 4 -161 discusses the prairie falcon nest site and needs to <br />be updated for the current permit term. Trapper should be aware that mining activities planned <br />for the next permit term appears to fall within the approved buffer zone for the nest site and the <br />surface activity may not occur within this area between March 1 and July 31St <br />2.05.6(4) <br />(4) There are no publicly owned parks within the permit area. One site is identified as eligible to be listed <br />in the National Register of Historic Places site, 5MF948. Section 4.1 of the permit discusses the <br />protection of cultural and historic resources. As indicated in the review section 2.04.4 above, additional <br />analysis needs to be done to determine any needed protection for site 5MF948. <br />2.06 Special Cateeories of Minin <br />2.06.8 <br />(1)- (4)Alluvial Valley Floors (AVF) are discussed in section 2.7.7 of the permit. Appendix H contains a <br />detailed analysis of potential AVFs within the permit area and their potential impact. The applicant <br />identifies three areas where potential AVFs exist within and adjacent to the permit area; The Yampa River <br />in the Big Bottom area, the Williams Fork River near its confluence of the Yampa River and four <br />drainages within the permit area (No Name, Johnson, Pyeatt and Flume Gulch). <br />(5)The Division has found in writing in the Findings of Compliance Document for the Trapper mine that <br />the operation will not interrupt, discontinue or preclude farming on the Yampa River and Williams Fork <br />AVE Also, the Division has previously found that the four gulches noted above are not alluvial valley <br />floors. <br />
