Tabetha Lynch, DRMS <br />Page 2 <br />4/30/2015 <br />2.04.4 Baseline Cultural and Historical Information <br />2.04.4(1) -(2) <br />(])Section 2.9 of the permit contains a list and a description of the cultural and historic resources listed or <br />eligible to be listed on the National Register of Historic Places and significant known archaeological sites <br />within the proposed affected area of the mine. One site is identified as eligible to be listed in the National <br />Register of Historic Places site, 5MF948. Section 4.1 of the permit discusses the protection of cultural <br />and historic resources. <br />(2)Appendix K of the permit contains the results of cultural resource inventories conducted for the site. It <br />should be noted that PR7 currently under review by the Division adds 774.8 acres to the permit area to the <br />east of the currently approved permit area. Trapper has not submitted a plan to affect land within the <br />expansion area. Prior to disturbance within this area, Trapper will need to conduct a cultural resources <br />survey. <br />There are several items that will need to be addressed: <br />• Pages 2 -588 and 4 -3 of the permit states that Archeological Site 5MF290 (A.K.A. 5MF949) is <br />within the proposed mine plan area but is outside of the permit area. This site does not appear to <br />be within the permit area or the mine plan area. These pages will need to be updated accordingly. <br />• Page 2 -588 indicates that site 5MF945 will not be destroyed by the mining operation; however, <br />page 4 -3 indicates that site was disturbed by the mining operation during the 1993 -1997 permit <br />term. Page 2 -588 should be revised to indicate this site was destroyed or disturbed by the mining <br />operation. <br />On January 8, 2015, the Division sent Trapper a letter regarding archeological resource site <br />5MF948. Trapper's permit Section 2.9 and Appendix K indicate the site is located in Section 8 of <br />Township 5 North, Range 90 West of the 6th principal meridian and is outside of the permit area. <br />Permit map M45 depicts this site to be located in Section 8 outside of the permit area. The <br />Division conducted on inspection of the site on December 10, 2014. The Division collected a <br />GPS point at the site and confirmed that the site is located in Section 5 within the permit area. <br />According to permit page 4 -3a, the site is 3,600 feet away of the closest proposed mining <br />disturbance. Based on the GPS point collected by the Division, the site will be about 700 feet <br />from the mining projected to occur in 2016 based on map M10a in permit. Given Trapper's <br />current mining plan, flyrock and airblasts will not likely affect site 5MF948. However, ground <br />vibration, if large enough, might affect the sandstone upon which the petroglyphs are painted. <br />The Division requested that Trapper submit a technical revision to update the following <br />information: <br />1.) Revise section 2.9 and 4.1 of the permit to indicate the site is located within the permit <br />boundary. <br />
