Based on worst -case subsidence projections, the RMG report determined that some <br />material damage or diminution of reasonable foreseeable use could result. Since the <br />potential for damage existed, damage evaluations were completed under applicable <br />provisions of Sections 2.05.6 (6) and 4.20. An evaluation of material damage or <br />diminution of reasonable foreseeable use for the Southfield mine area was determined <br />on a site -by -site or structure -by- structure basis, excepting those structures included <br />above in the inventory in response to RN -06. These estimates are valid for the <br />additional areas included in the revised permit boundaries due to their similarity, <br />limited size, and proximity to the original permit area. <br />The Thompson ranch house and associated buildings are located over the main <br />Southfield mine entries that were designed to provide full support. This area has not <br />been previously undermined by historic mining activities in the vicinity. Since the main <br />entries were developed using a full support design, minimal or no subsidence <br />occurred. <br />The ranch buildings are situated upon two (2), ten (10) acre surface tracts conveyed <br />to the Thompsons by Robert Jackson and Edward Cribbs on June 16, 1965. The <br />associated transfer of surface ownership included a specific reservation giving the <br />grantor ( Cribbs- Jackson) the right to mine the coal and contained an explicit waiver of <br />all rights to surface support and released the grantors from all liability for damage <br />resulting from subsidence. A copy of the deeds as recorded is included in Exhibit 23, <br />Subsidence Information. Dorchester mined coal from the Cribbs- Jackson property, <br />including the area underlying the Thompson surface, pursuant to a lease executed in <br />May, 1978, between Dorchester and Cribbs- Jackson. The reserved mining rights and <br />subsidence waiver in the recorded deeds constitute valid property rights which were <br />conveyed to Dorchester by the Cribbs- Jackson lease and were subsequently <br />transferred to EFCI. While Dorchester's and subsequently, EFCI's liability for <br />subsidence damage is expressly limited, the CDMG requires monitoring of all <br />potentially affected structures within projected subsidence limits. <br />Damage to county roads within the mine area was expected to be characterized, in <br />extreme cases, by surface cracking or buckling and vertical displacements as a result <br />of subsidence troughs. The locations of these features were expected to occur where <br />roads intersect the center portions of the mine panels, and rib side and end lines, with <br />2.05.6 -57 <br />Revised 5/14/14 RN -06 <br />
